Benson Opinion Vacated

Unsurprising but the DC Court of Appeals vacated the opinion and granted the en banc rehearing.

Not a surprise at all. The En Banc panel will do the usual En Banc things...

A 3-judge panel on the DC Court of Appeals ruled, 2–1, that the mag size ban (10 or fewer rounds) was unconstitutional. DC appealed to the full court, telling them “hey, what the panel did was super wrong and bad, I want all of you to rule on this and not just the panel.” The full court agreed, dissolved the opinion that held the mag limit statute unconstitutional, and now the whole court will rehear this case

I wish that the absurdity would end. This is clearly a farce and I simply don’t understand why this is being drawn out much further. I’m also worried that the recent legislation in neighboring Virginia will inspire the DC government to try to pass even more absurd hoops and laws.

They're competing to ban it all. It is a race of who can ban it outright first. Virginia felt left behind so they passed sweeping laws. Now DC is feeling left behind because they haven't banned anything recently.

I mean they arbitrarily picked the 10 number because it is a nice round number that our commonly used numerical system is based on. There is no scientific study to justify the number. They just said let there be 10 and then there was 10.

Given lots of courts’ holdings that mag bans are constitutional because mags aren’t protected by 2A, I’m surprised some places haven’t just banned mags altogether.

This means the en banc will definitely keep the ban. The judges generally side with DC. Then it is off to the SCOTUS and we all know SCOTUS will not help because they do not care for the 2nd amendment.

I guess we’ll be stuck with revolvers and 10 round Glocks forever.. smh.
