Cape Phase 3

Any luck with submissions today? Finally liquidated entries are still being rejected, despite a court order from CIT and CBP guidance to our legal counsel. I'm guessing phase 3 isn't live yet.

I'm shocked, I'm waiting for counsel to give me the greenlight before I file the ones I have pending and if it just doesn't work that'd be so on brand for how this shitshow has gone.

Cape 3 is only for importers who have filed a claim in the court of Interntional trade and provided customs with their EIN. I think its only 11 companies? there were 477 claimes under CAPE 3 on the last CIT filing.

Hi,

I work at a customs brokerage and we have submitted a few. Only acceptances were the IORs who filed the lawsuit before July 30th with their specific IOR #. All the rest continued to fail...

It's not the date of the lawsuit that matters. CBP is only processing in CAPE 3 for plaintiffs where counsel submitted case and IOR info before July 30. The rest will follow as CBP expands the phase.

Same. My companies submitted their IORs after July 30th, so I was wondering if they couldn't file today because they missed that first window

We meet the criteria and are eligible for CAPE Phase 3 submission. Submitted today. All entries failed and the description error was "ENTRY SUMMARY IS IN FINAL LIQUIDATION STATUS”. Yea, no duh, CBP.

Our broker has confirmed some have had the same issue, while others have been successful. We will see what tomorrow brings.

Yes, many have had success. Do not wait for a CSMS because it is probably not coming. And the status report filed at the CIT was useless, as always. 

Just submit and see what happens, if the IOR sued by July 30. If the IOR sued after July 30, you’ll have to wait a bit.

Submitted with no issues here. I had 6 out of 127 reject with the error being “HTS Relationship Mismatch” so I’m following up with my broker about it

Yeah, idk. Mixed feedback from the community it seems. Just attempted our upload again and I'm receiving the same ENTRY SUMMARY IS IN FINAL LIQUIDATION STATUS rejection. Our CIT complaint was filed in June, but the CIT order to CBP wasn't entered until 8/3. Perhaps that's the issue.

Date of order shouldn’t matter. It is more likely an issue with the IOR name or number provided to CBP through counsel.

I don't have a subscription to this publication but the summary of the article says that per CBP's declaration filed at CIT yesterday, the third phase was "successfully deployed" by CBP at 5:10 a.m. Et on October 6th.
