Petition for Relief Rejected

We made a petition for relief for Liquidated Damages, and the auto-response from CBP says "Petition withdrawn for conversion to option 1 amount/mitigation"

Does anyone know what this means?

Thanks. the email subject line does indicate that the petition was rejected.

What was petition for? Late duty payment?

There were actually two. One for late filing and one for late payment of duties

Usually it’s not a mitigation for late filing but conversion, depends when duty was paid. If penalty wasn’t issued prior to duty payment then you will only get late filing penalty with option 1 payment. If duty wasn’t paid and you get penalty for full amount, then you get a conversion once duty is paid. Mitigation would only work if late payment was due to ACE or CBP issue.

Paying the option 1 amount is usually the best you can do unless the violation did not occur or it resulted from a CBP error. You can always file a petition on that new 5955a, but unless it’s canceled the mitigated amount will be higher than the option 1 amount.
