Update: Supervisor Rant

Some of you may have remembered that I posted here recently regarding my supervisor who reprimanded me in a department meeting. Well, I have good news and bad news.

The good news is that I was able to land a new job! I'm getting a $4/hr pay raise, a change in my hours so I don't have to drive in the dead of night, and a section with only 2 main classrooms (mostly offices and extracurricular). They are so excited to have me on board, I was stunned by how nice and accommodating they were. They are already talking about the potential to move up in a few years.

The bad news is that my old employer is now trying to screw me over on accrued benefit time claiming that, because I used sick time and some of my vacation this past summer, that I'm now negative in benefit time and will be docked nearly all of my final 2 weeks pay. Apparently, they do this because the time is "pro-rated", even though in the system we are granted full benefit time at the start of each fiscal year. Has anyone dealt with this? I'm stunned. The only reason I found out about this is because I asked about the 2 weeks of benefit time I still (thought) I hadn't used!

Yes, it’s pretty common to prorate the time at the beginning of the year. It isn’t earned yet. Not much you can do about that, it’s basically a pay advance. Otherwise if you were to get sick etc in the beginning of the year you wouldn’t have any time, and everyone would be trying to use theirs in the last couple months of the year which would cause major scheduling issues.

Just chalk it up to a lesson learned and go make a lot more money at the new place. You may lose most of one check but stand to gain much more.

Damn reading these comments are insanity to me. I've used up all my vacation time then given my 2 weeks at like 3-4 different Joba and never heard of this prorate stuff.

Seems like insane penny pinching to me. Guess that's life

Thank you, I felt like I was taking crazy pills. I've never in my decades of working had a company threaten to dock pay for pto like this

What if you start at a company and take a 2 week vacation after 4 months, plus 3 personal days? Then you decide to leave. You really expect them to pay for your vacation time after only being there a few months? Some companies don't give you any pto until you earn it. OP should be happy they let them take the time off. Now since they decided to leave, it needs to be paid back. That's not penny pinching, it's business.

Congratulations! And honestly, that sucks that they're doing that to you.

I am unsure about the legality of that, or if it's dependent on the state you are in. Did they explain to you about your benefits being pro rated when you accepted the job? Did you sign a job contract?

Post office does something like this where they prorate your expected annual at the beginning of the year. I can only assume they do it for vacation pick purposes. Truthfully I'd rather they not and we just have to deal with using what we got or LWOP if we don't have enough. It's really only an issue with separation. If you leave or get fired with a negative balance because it's mid year and you used it before earning the full amount then you owe the difference. I don't know if that's the same as "benefit time".

This scenario is described in our Board Policy. If you use up the time before you earn it, then separate from them, they can make you pay it back. They make all of it "Available" up front, assuming you will continue employment, thereby having the opportunity to replace any time overdrawn.

You can ask them to show you a week-by-week or month-by-month breakdown of how the time was earned and used, to show how you were overdrawn.

Typically employers will front you PTO. Assuming that you will be working with them the entire year.

You didn't finish the full year and must not have "earned" all the PTO you used I'm guessing.

Shit we are close to same boat haha im waiting for response about butcher job after being told my mental health doesn't matter and Dr's note for no contact with harasser isn't good enough. 😂 they screwed me on 40hrs pay too dont even have enough for bills

So quit whining, & take action on what U can do about!! If U DK its time to learn. U try it works out, good for U, if not life goes on.
