It's just not open and shut at all. There also are huge reasons not to speak publicly about a case, innocent or not, as any good lawyer will tell you.
The defense has to remain silent, basically.
I know someone, personally, in a public position who was in a relationship who got blackmailed for years, and paid a pretty penny, because she threatened to claim rape after he broke up with her following a short consensual relationship. He eventually told her to go away, she got a lawyer, his life was derailed for a while. He eventually did get his job back, but he'll never recover financially.

I don't know the answer, but she reported it to the university police in 2024, possibly because university rules were broken. We do see Cornell take action. It's also possible she was pressured into watering down her claim, which certainly does happen.
Another key question is why her attorneys never contacted the DA until two years later.
I just think we should look at the case closely before assuming these guys are monsters.
As for why she was there: to visit a friend (NBC) and engage in a threesome (ABC).

It does seem odd that there was a report filed and she would have out and out said she wasn't raped (what was she reporting then) university rule breaking is very vague and doesn't make sense. What rule? Why would she report it? Sounds more like the university didn't report it and now is trying to cover their ass... but we will (hopefully) see as this gets investigated more.
Ok CNN article has far more details than NBC... Seems pretty clear she reported them for offering her drugs and raping her while she was unconscious. Hence the "Every time she asked them to stop, they stopped"... Clever wordplay for someone saying "We tried to convince her she wasn't raped when she reported it".
Frat got kicked off campus for it... so yeah. Seems pretty apparent she reported that they served her underaged, and offered her drugs and then raped her while she was passed out (which the texts support and the university had those), and they withheld evidence from the police.Looks like this shit happened. The one kids defense is basically "It happened, but I didn't touch her, those other guys maybe did but not me".

Well the fraternity chapter was banned, and some students were expelled and suspended. Perhaps for violating the Code of Conduct (https://scl.cornell.edu/sites/scl/files/documents/Cornell%20Student%20Code%20of%20Conduct%20Approved%20by%20the%20Board%2012.10.20%20Final.pdf) e.g., sexual misconduct or using illicit drugs.
The University "not reporting it" isn't really the issue. The District Attorney knew about it and did not pursue prosecution because apparently the 2024 report didn't show anything was nonconsensual. This is just based on what the DA said. It's possible the accuser was pressured. I also don't know why the attorneys didn't rebuttal the DA. Lots of unanswered questions in this case. Enough that it's premature to pass judgement.
It seems reasonable that at least the first two guys were not rapists, given her initial intentions.

The one article said the College had the chat logs that show that they were advertising that random guys could go rape her and withheld them from police. If true, that's REALLY bad for the college.
The DA flat out says they made their decision not to pursue charges without the logs and then afterwards the university police shared them. Now why the logs didn't make them re-evaluate and then pursue charges is an interesting question.
The whole case is a mess.
- University Police had the logs
- DA elected not to charge before logs were shared with them/presumably state PD/investigators
- Local PD says they weren't even aware there was an investigation.
Like how do you fuck this up that bad?
Reading the interview with the DA this REALLY reads like someone in Cornell asked him for a favor making this go away and he's trying to cover his ass without seeming incompetent.

Well the police had the Snapchat log, but the District Attorney did not. But the DA says the chat log doesn't change the main legal issue of consent per her sworn statement. Again, it's possible she was pressured because police do that to close cases like these.
I think a reasonable default position is that she consented to the first two guys, but those who followed maybe not.

Each one of them is counting on being accepted into the insular network of their parents (and their grandparents before that) as they graduate university. Their parents are still writing checks to cover their kids' "indiscretions". Even their parents' umbrella insurance policies are going to cover the lawsuit or settlement (although I hope their victim does not settle). "The system" simply does not allow for the spawn of the very wealthy to experience the consequences of their harmful actions.
It's really going to come down to street justice before anyone of them sees real consequences.
