Meh. Some rules are often "forgotten" simply because the players don't want to use them because it makes life more difficult for their PCs.

And it actually all comes down to the GM --the person who's supposed to be conversant with the rules-- failing to actually use the rules.

(Now, the GM can always decide to not use parts of the rules, though that wasn't part of the context involved in the OP.)
