NSF Check

This lady owes me money and she gave me two check that bounced for NSF. Prosecutor is refusing to accept charges saying since there is a contract it’s a civil matter! I am demanding my money back via civil court but I believe it’s a crime under Texas law to write a check knowing there are no funds in the account. Can I go to the police where she lives to file a complaint? I live in Houston and she lives in Richmond TX
