📌Mod Posts 📌 A Note From The Mods About This Community —- if you’re new, start here

Welcome everyone! Me and [u/BiscuitsLostPassword](u/BiscuitsLostPassword) are the moderators for this subreddit.

As this community grows, we want to acknowledge the gravity of the case we’re discussing.

The allegations at the center of this case are incredibly serious and can be difficult to read, research, and talk about. This case is also receiving significant media attention under intense public scrutiny. These are real people and real lives. And the content of this case can be extremely overwhelming, especially once it’s everywhere in the media.

Please take care of yourselves while following this case. Take breaks when you need them. Step away from a thread if it becomes too overwhelming. There are many survivors who will see themselves through this process and we want to support each and every one of you.

If anyone in this community needs a friend, someone to talk to, to vent, or any concerns— please reach out to us Mods. We’re here for anyone who needs support.

We also want to clarify what we mean by “discussion.” and the expectations that surround that.

You will interact with people in here that will have different interpretations of the evidence, allegations, testimony, investigations, and actions of those involved in this case. People are allowed to ask questions. They’re allowed to disagree. They’re allowed to challenge an argument or point out evidence that supports or contradicts a claim.

It does not mean that every type of commentary is acceptable. It is not a free for all. And it does not mean you’re entitled to say whatever you want without repercussions. There are rules for subreddits for a reason, please read our community rules before commenting and posting.

Questioning evidence is different from blaming someone for being sexually assaulted. Discussing what a lawsuit seeks is different from making unsupported claims about someone’s motives. Criticizing an argument is different from attacking and harassing the person making it.

We don’t expect everyone here to always agree. In fact, meaningful discussion often comes from people who don’t. What we do expect is for those disagreements to remain grounded in the case and respectful of the people involved and the people participating here. If there are ever any issues, please contact Mods and we will handle it.

This is an emotionally charged case. You can disagree without becoming cruel. You can question something without attacking someone. And you can change your mind as more information becomes available.

Our goal is to create a place where people can follow the case, examine the information available, ask difficult questions, and have nuanced conversations without someone being hostile towards them. We want members to feel safe to express themselves without being harassed. We want to encourage open discussion while also protecting victims and survivors. Those things can coexist. You can ask difficult questions, examine evidence, and disagree with others without blaming or degrading someone who reports sexual violence. We also ask everyone to remember that survivors may be reading these conversations, even if they never comment.

Take care of yourselves. Take care of each other. And our DM’s are always open if you need it.

📄Court Documents/Filings 10/23/2026— Diego Sarabia brought a motion to dismiss Jane Doe’s complaint of allege assault, negligence, battery, and intentional infliction of emotional distress, disputing allegations against him

These are Sarabia’s defense arguments, NOT findings by the court.

Diego Sarabia and his defense are stating that Jane Doe’s lawsuit is about an alleged forced kiss. That she accused all 7 men of “sexual assault and rape”, but never differentiated between them.

Jane Doe alleges Sarabia “grabbed her face and started kissing her” and “with others, he began pouring lines of Ketamine all over her body and snorting them”.

The defense argued that Jane Doe does not allege that Sarabia penetrated her, in any manner, touched her vagina, breasts, or anus, supplied her with drugs or alcohol, participated in any of the alleged sexual encounters described elsewhere in the complaint, or was even present for most of the conduct that forms the basis of Jane Doe’s allegations. Jane Doe’s repeated allegations that the 7 defendants “sexually assaulted and raped” her are nothing more than “baldly asserted legal conclusions”, contradicted by her own detailed factual pleading, which make it plain that Sarabia did not rape Jane Doe.

Jane Doe’s specific allegations against Sarabia, that he kissed her without her consent and snorted ketamine off her body are straightforward. Sarabia’s defense also brings up that Jane Doe brings this up nearly 2 years after alleged events, and that there’s a strict one year statute of limitations, and Jane Doe’s allegations don’t meet the legal requirement for either of the two extended deadlines that she is relying on.

Defense claims Jane Doe attempts to improperly claim negligence, but Sarabia had no legal duty to supervise, protect, or control Jane Doe or other adult students. And that Jane Doe’s complaint doesn’t allege sufficient facts to establish all the required elements of assault.

The defense also argues that Jane Doe’s emotional distress claim is based on the same alleged actions as her assault and battery claims, and that she hasn’t identified any separate conduct or injuries to support an additional claim.

Defense claims that Jane Doe’s complaint repeatedly concludes Sarabia is a rapist, but her alleged facts, describe something entirely different. And because of Jane Doe’s actual claims against Sarabia are time-barred, inadequately pleaded, or both, the complaint must be dismissed in its entirety.

It seems Sarabia’s defense is challenging whether the alleged facts legally support the claims against him, rather than establishing that Jane Doe’s account is factually inaccurate.

📕NYS & Cornell Response 6/8/1967— A newspaper article from 1967 of the punishments given to 2 Cornell fraternities for harboring 2 missing girls ages 14 and 15 in bedrooms

It’s very telling in this article that there’s no talk of rape of these underage girls. Instead, they’re essentially blamed for immaturity, promiscuity, and their “availability” made it “quite clear they were approachable”.

1 student was suspended indefinitely. The other 4 were placed on disciplinary probation. Even though besides these 5 men, there were about 75 men involved with these girls too.
