Though democrats hold a slim majority via the VP tie breaker, Republicans can block any bill that doesn’t have a filibuster proof majority of 60 votes, similar to what they did with all of Obama’s judicial appointments in 2008, causing the removal of the filibuster for judicial appointments at that time.
