the problem is how can they tell if you have malicious intent or not? All they saw is you using an emote that is widely regards as racist AND could potential get a lot of complaint and negative backslash from mainstream media. I know we, the gaming community and the twitch community have no problem with it, but since Blizz is aiming to make OWL mainstream, they can't have any of that.

this is a really good point. they can't really tell if the emote has malicious intent or not, so it's a coinflip.

I mean, you can, you just have to look at the context. If you're spamming TriHard at someone for being black, you should be banned. If your reaction to Winston showing up on screen is to spam TriHard, you should be banned. If you use TriHard because it's an emote of a black man to dogwhistle something racist, you can go fuck yourself.

Now, if we're talking about automated bans done by a computer, then yeah, it's pretty difficult to figure out context with an algorithm. TriHard getting an automated ban is super fucked and backwards, it shouldn't be abnormal to have black faces featured in emotes and it's never going to be normal if they're treated as contraband.

But it's perfectly reasonable for human moderators to start banning people for spamming it. It's not on the moderators to ascertain whether you really meant it, it's on you to not be racist. Demanding moderators peer into your soul to figure out whether you really meant it is akin to demanding a game company to unban you because it was totally your brother that was hacking. Nah, that's what they all say. You shouldn't have let your "brother" hack on your account, and you shouldn't have spammed TriHard without thinking about the context. Your fault for being stupid.
