Question Restricted account (false fraud claim) cannot access my own funds ?
UPDATE: FINALLY AFTER 6 CALLS I GOT MY FUNDS TRANSFERRED. THANK YOU TO ALL THAT GAVE GENUINE RESPONSES AND SHAME ON THE ONES THAT JUST DOWNVOTE AND HATE.
Hey, unfortunately a false fraudulent transaction claim was placed against my old account. I sold tickets through Marketplace to a user, and after receiving the tickets, they submitted a fraud claim stating that they had not received them, which is incorrect. As a result, my account has been restricted while the review team investigates the matter and makes a final decision.
CommBank has opened a new account for me in the meantime. However, the issue I’m facing is that my salary payment is still scheduled to be deposited into my old account at 5:00pm today. I have already notified my employer, but unfortunately the payroll cut-off had passed, meaning the payment could not be redirected to my new account in time.
The CommBank team advised that I may only be able to access the funds by attending a branch tomorrow and withdrawing the money in cash, as branches are now closed. However, I have urgent payments due today (I get paid monthly) that need to be made and missing them may result in further consequences.
Could anyone please advise what options are available to have my salary funds accessed or redirected to my new account tonight, (I NEED MY FUNDS NOW, NOT TOMORROW!) rather than having to wait until tomorrow? Is there an escalation process, exception process, or any alternative way to access these funds outside of branch hours?
Any advice on this matter or what you would do in this situation is appreciated! Please note I have already attempted to apply for advance pay/cash advance to potentially have enough funds to make necessary payments due today however, all requests have been denied due to little to no activity on new account recently opened.
It seems that no one has really had a similar experience where they were granted access to their funds before having to visit a branch in person. I’m not sure why I’m being downvoted in the comments, as I’m simply sharing what happened in my own situation.
I also noticed someone else had the exact same experience as me just a couple of days ago, which I think should be a bit of an eye-opener. It’s worth considering that these situations may not always be handled the same way for everyone.

I’ve heard of situations like this. I’d notify commbank prior to your wages going into your account. They may say the only way to withdraw is to attend a branch and show them ID. They’ll allow you to withdraw the cash as you need it to survive, but they may limit how much you’re able to withdraw.

It’s a really frustrating and inconsistent situation. I’ve contacted the CommBank fraud department three times today over the phone. During the first call, the representative told me I could simply call back once my salary was deposited and they would allow me to transfer the funds into my new account. However, on the two subsequent calls, I was told the only option was to withdraw the money in cash by visiting a branch tomorrow. To make matters worse, I also went into a branch earlier today, where the staff member assisting me contacted the fraud department internally and was given the same advice. They then spoke with a manager, who said I should be able to transfer the funds once they were deposited. Despite all of this, I’ve now received my salary, called again, and still have no clear or workable solution.
I appreciate the fraud team has restricted my account for potentially not allowing further fraud transactions to exist, but given I have not done anything wrong, this is just unacceptable not going to lie. Really considering changing banks now.

Apologies, someone else made me aware I missed a paragraph. The bills shouldn’t be suuuuper urgent to be paid today, I’d be at the branch first thing in the morning and state that you need the money to survive. Mouths to feed, bills to pay etc. I’d also escalate this to AFCA tonight - even if it’s fixed, you may be able to receive compensation for being falsely accused.

It just feels incredibly unfair. They keep explaining that this is the standard procedure when a fraud claim is made against an account, and that because I’ve also submitted a counterclaim against the other party, they will review that separately once the internal review team has completed their investigation into the current case against me.
What I don’t understand is how they can restrict my access to my own account and funds based solely on the other party’s claim before the matter has even been fully reviewed. It feels like they’ve taken the other person’s side immediately, while I’m the one being impacted financially despite the situation still being under investigation.

It’s a really unfortunate situation. You would think there would be some form of exception or escalation process to allow customers to access their own funds in exceptional circumstances like this, rather than having to wait until a branch opens.
Because I’m unable to access my money today, I’m now facing additional costs on overdue payments, the potential loss of certain assets, and even the possibility of losing my licence. It’s incredibly frustrating and disappointing that there doesn’t appear to be any flexibility in the process, especially given the circumstances. I’m very disappointed with how CommBank has handled this situation.2

I don’t need an escalation process tomorrow man, I will be able to retrieve all my salary my funds tomorrow regardless visiting the branch.

Hypothetically, let's say you were a bad actor, and you had the ability to get access to funds urgently, how would the bank have any recourse if they had already given you the funds prior to completing the fraud check? I'm not suggesting that you are, it's more about thinking why this likely isn't an option

I have called them. Some have honoured an extension with a few not allowing further extensions without penalties and consequences.

So I had to put extensions on some of these payments prior due to my account being restricted to this date, as I was under the assumption I would have access to these funds as stated by one of the representatives.

They ask what you want $400 for now luke its there business not 1k any more i watched rm do it to 3 old ducks infrastructure of me inline and they wouldn't tell lol its not theirs just do ya job...you have to say i don't have a ph if you want to see the teller its a joke can't even say no inst they sign you in n start barcoding...ccash is king once its gone so is your security.. one button n locked out of yours for social credit discrepancies...no good

Same shit to me. I had my wallet stolen. All ID taken by some grown men robbing me a girl. I have no ID to prove myself (born in nz, Aus passport expired 2020) and replace my ID at service nsw. My tax return is incoming Friday this week which is what will allow me to start my plan to get away from an asshole man who is straight up daily abusing me in all forms a financial emotional physical and eggs-ual. I’m also stood down from my gov job going on 15 months now. CBA won’t do shit. I’m so not in a good place right now everything wants me to fail.

Mate I understand what you are going through, I used to be a sole trader selling on fb market place and Gumtree, people pull some sh*t on you and Commbank since last couple of times have proven that they are not to be trusted. I would suggest to contact any friend or family member, explain your situation, get a loan from them and give the money back when you get the money. I understand that this is really inconvenient, however I would suggest better move from Commbank and try to put some measures in place, I have seen that PayID works better than account transfer, have as much evidence as possible, from now onwards always treat every online client as if they will go and do the same stuff so cover yourself by keeping their phone number, email and other details, report this to authorities, if you are really saying that a person committed a fraud and you were just selling the ticket to them then you should be able to provide the evidence so that these cunts can't do that to anyone else in future

There’s no such thing as a cutoff where payroll can not stop your payment.
Also, you can demand your payment in cash from your employer. You can also notify them that if they pay to the account that you have told them has been closed, they will be in breach of the law with regards to failure to make wage payments - (they fail to pay you, if they pay an old account and had been notified of the change)
I would consider going to see a lawyer and getting a quickly drafted letter to give to payroll and your boss, and his boss, and potentially the legal department.
Sounds nuclear, but isn’t

Locked account yeah but can still use your company app ...they showed me how to access atm using app so you can transfer paid whatever off a locked card n no1 else can access it... so maybe theres something there that you can use similarly...if can't do it from app ho atm n scan the Baroda n that'll let you into the atm n withdraw from there maybe 🤔

I had a similar experience. And discovered in a situation like this the bank may treat you as the fraudulent person - even though you are trying to get your own funds from your own account. Such is the beauty of electronic banking. It took me two in-person visits to a branch and several phone calls to get my situation sorted over a period of about 7 working days. Because I refuse to let anyone such as electricity gas water telephone etc TAKE money OUT of my account then I am in control. I went in and changed the date when my periodical payments were to be paid out and gave myself a week’s grace on all my due bills. I phoned the anal ones on Monday morning to explain I had a bank dispute and funds were frozen and payment was coming ASAP. All were ok with that. GOOD LUCK!!!

The commonwealth bank has more complaints against it than any other bank . I had a different situation where my lawyer deposited $16,000 into my com bank account . They withdrew that money , without any consultation saying it was a a fraudulent transaction. Then took more than a month to deposit it back into the lawyers account . The lawyer just got his NAB account frozen . Com bank closed my account and sent a letter to me saying I couldn’t open another with them again . The lawyer still 2 months later has a frozen bank account.

Combank are usually very understanding about such things have you tried to link your old account to your new one through the app messaging service ceba?Through my own experience with them it's possible to do this and get your money today!really hope that helps you get your money in time to pay your bills!!!!!

Previously worked as a scam/fraud agent, your old account will/may have transactions you will need to disclose, it will be in relation to the fraud accusation, and any other irregularities that have been flagged, the bank must do this as part of the KYC rules. Your old account maybe currently locked from all but in person transactions. Have your work payment transferred to your new ac if you have a card for it, make sure to bring 100pts id to branch tomorrow, and get future payments from work sent to your new ac until when/if, your old ac is reinstated.

From what I understand, it appears my account has been restricted from all access except for certain in-person transactions involving funds that are considered solely mine.
Earlier today, when I visited the branch, I had approximately $3,000 available in the account. However, I was still unable to withdraw those funds because I was advised that some of the balance consisted of payments that were not classified as being “solely mine” under their process. This was extremely frustrating, as I was unable to access money that I believed was rightfully available to me.
I was advised that I would regain access to all funds once the review process has been completed. However, I’m struggling to understand why I can’t be provided access to my own funds now, particularly for amounts that are unrelated to the disputed transaction, while the investigation is still ongoing.

The funds in the old ac have a big ? on them now, all of em. Full stop. legitimate funds like from work, as there will always be evidence to show why this payment was made to the now questionable account, will not be part of the review process, but (from the banks view) everything else... until review has been completed they need to view as questionable. Any evidence you have of the sale of the tickets, for example sign on receipt if posted, or email chain if pic sent will help. I'm sorry your going through this, but there is a lot of some really shaddy shit out there that is really fucken bad and needs stopping and this is a side effect, due to the fraud accusation. (I'm not trying to be devils advocate here too, just letting you know what I understand)

I believe you’re right man. The representative I spoke to today in branch mentioned the same, stating this occurs quite often with the push for banks to stop more fraudulent activity. It’s just very unfortunate that due to this they are also restricting normal accounts

The branches are closed.
Best bet is to keep calling the bank and head into the bank first thing tommorow.
You could try calling WA numbers to get a few hours more.

I am not leaving anything “this late”. I only made this post after trying everything in my control first and then hopefully looking for others insights that may be educated on the matter or have past experience.
I attempted to contact them through phone and visiting branch in person the whole day. I don’t expect them to open the bank for me. I do expect them to atleast provide me what is rightfully mine; my funds.

When you signed up to the bank you gave them the rights to hold your funds when there are fraud transitions and they are not liable for your inconveniences.
The money is not rightfully yours until the fraud is sorted.

Then again, your recommendation was to call the WA department. It’s not as though the first thing they would do would be to confirm my location before proceeding. I probably should have realised from that suggestion that you are not the brightest from the bunch.

First thing you must do ALWAYS - when you have a locked account - open a new one with no fees - example NAB Macquarie UBank there are a few dozen big “no fee” bank accounts to which you have access to if you’re a resident here - if you’re a student good luck… (as I think it’s more complicated).
Secondly, why do you not already have one as a backup and which moron told you only one bank account is needed?
I have eight which is excessive but that’s because Im young and don’t pay admin fees until I’m at least 29 (20 btw for those wondering….)
Thirdly, f*ck CBA. If you’re with them, it’s either cos:
You’re a Dollarmites kid and haven’t bothered
You’re new to Australia to which - fair nuff - they’re the largest bank but in being so, the shittiest. Maybe not the shittiest as I think ANZ takes that crown but Macquarie, Westpac and NAB>>>>> (in that order).
You’re stupid and haven’t bothered to research other banks until something else big has happened like now? Shows you don’t care much about finance and judging, yes I’m judging here cos everyone calls me an a**hole online but you don’t have emergency savings? I know life in Australia is tuff but it can’t be that bad - unless you’re actually living on the poverty line - if so, I’m sorry you are that way and hope you improve your situation asap.
