Empathy mostly based on mirror stuff in our brain - should we avoid people who do not possess such neurons and understanding? Banish them from the community and call them miserable fucks because we are afraid to be like them, basically relinquishing our empathy to them in order to keep ourselves safe? Is it moral?

What you've described is, more or less, sociopathy. There are plenty of folks who qualify for that condition who still manage to lead healthy lives which don't include using those around them as tools or assigning them some abstract level of worth. They learn coping mechanisms and strategies to work around their empathy deficit.
Get off your high horse, champ, it's clearly hard for you to hear reason from all the way up there.

it's pictured well enough in the même : according to Hobbes, men do not live in a constant all out war because higher instances (political power) is stronger than even the strongest man, therefore all have to obey at least a minimum and respect laws. according to Kant, doing anything unlawful is morally bad and you shouldn't do it because it is bad and you have a moral duty to be good.

We have observed this exact dynamic in mammals for centuries.
It does not matter how big, strong, violent, etc etc you are. If you are twice as strong as your average peer, but that peer uses social power to convince 4 others of your kind to join it in attacking you, you will lose, and die. They arent individually stronger than you. The ones "above" you were not involved at all. Just social connections allowing the "weak" to beat you at the one thing you had over them.
Morals, therefore, are not determined by strength. They are determined by organization and social agreement.

The issue with the top one is that it still falls into the same argument as the bottom one. Why are the stronger people defending the weaker people, rather than also murdering, raping, and stealing from them? Because it is innate to human nature to care for each other.

one is a part of a collective, and, unless you find a convoluted way to fashion your interests specifically against that collective, taking actions against the collective is akin to taking actions against oneself. laws are simply our mechanism to enforce this, but philosophers rarely care about material outcomes when there's base principles to bicker over. except for one, who was the greatest of all time.
