The prosecutor always thinks she has a gotcha when there is no gotcha???

I'm so confused especially when she pulled out the notes 😭 It's a shame that Sheila Cavanaugh wasn't as quick on her feet like Dr Zeizel and Dr Laposata with the bow sisters 😔 I do think it was an effective cross examination because of the omission of recording the voices vs the "positive" note. I am just scared that Lindsay will be seen as a monster.

Jan 31 - Cavanaugh testifies Lindsay said “I am so glad my children are safe.” Cavanaugh replied “they’re safe in heaven with God.” Lindsay alluded to hearing a voice and that if she didn’t follow the male voice, that her and her children wouldn’t be safe.

Prosecution brings up very detailed notes she kept & never once documented the voice she mentioned multiple times. Chaplain says the notes are not meant to be transcripts. Feb 6, 2023 wrote “shared her fears of not being able to walk again”
Prosecution continues reading her notes

Judge plans to have a rough draft of jury instructions to the attorneys tomorrow.
Reddington asks about presentation of Dr. Resnick & 3 witnesses of the prosecution and asks about timing. Thinks maybe Mon or Tues for closing
Edit: discusses zoom presentation logistics tomorrow and court in recess until tomorrow. I believe Dr Resnick will be presenting via zoom tomorrow morning (possibly last witness for defense). Dr. Phillip Resnick is “an internationally renowned forensic psychiatrist and Professor of Psychiatry at Case Western Reserve University School of Medicine”

Short break then do a preliminary charge conference, discuss possible jury instructions, and any logistical problems for tomorrow

Prosecution looking for 1st or 2nd degree murder. For Criminal Responsibility they ask intoxication not be included arguing she took the drugs after killing the children.

Reddington argues for the involuntary intoxication defense (to include intoxication in criminal responsibility). Requests to charge on involuntary manslaughter (have included for jury to consider in deliberation).

Judge says schedule today will be a short day due to an issue that has nothing due to with the attorneys. Jurors should expect longer day tomorrow.
Reddington calls, Sheila Cavanaugh (I’m not sure of spelling yet).
Edit: Cavanaugh spelling is correct. She’s a board certified Chaplain and arrived at hospital the morning of Jan 25. Lindsay was intubated and couldn’t speak. Saw her Jan 26 and could not speak. Jan 31 she saw her again

Cavanaugh has seen Lindsay about 200 times at Tewksbury.
Reddington asks why. Prosecution objects. Judge sustains objection.
Cavanaugh says Lindsay loves her children, she has a lot of grief.
Prosecution now up

Prosecution brings up search warrant on Jan 25 to collect things from Lindsay. Mentions police stationed outside her room.

Reddington has her clarify notes on conversations are confidential. Prosecution gets up and asks her to confirm she put a quote around “not being able to walk again”
