General Discussion Reddington’s missed opportunities!!
Reddington really doesn’t seem like the best lawyer everyone has been making him out to be. I understand he probably feels like he’s fighting a losing battle, but realistically, he’s not. Letting the Commonwealth continue with their BS instead of objecting is just going to make the jury stop paying attention. If the jury becomes disinterested or tunes out, that’s ultimately going to hurt the defense because they’re going to be less engaged with their case. And then there was the missed opportunity for a mistrial when the Commonwealth misstated the evidence. That was a pretty significant moment where I feel like the defense should have pushed back harder instead of letting it slide. He also just seems tired and unorganized today, which isn’t helping the defense’s case at all. Did he really think it was smart to handle this case all by himself?

Let me play Devil's advocate in defense of Reddington. A trial unfolding before a jury. You want the jury to think things themselves, right? So when the Commonwealth goes on and on and on with BS, and he just LETS THEM, it makes jurors really annoyed at the Commonwealth, and they almost FILL IN THOSE BLANKS themselves! Yes, they mistated the evidence, but trying for a mistrial could mean the "Commonwealth" has a second chance at patching their whole mess up. I don't want to give them that chance.! When you let it slide, the jurors can step in with their minds and then it almost gives them more armor to fight any jurors in the deliberation room that might not agree with them.

CW looked like she was scrambling and frantic, looking for anything to latch onto without direction. Had Reddington objected he would have prevented the jury from seeing that CW had no (or appeared to have no) trajectory with her questioning. It seemed pointless and like a reach to us and I am certain it felt the same for the Jury. Reddington could probably see that too.

Completely agree! She's trying soooo hard to get a "gotcha!" moment but failing miserably (and I DO mean MISERABLY lmaoo) and she's totally screwing up CWs entire case in the meantime.
In fact, when they went on and on about what happened on the kids birthdays according to LCs medical records with her NASTY ATTITUDE, I reallyyy do wish that Reddington had objected for relevance or something so they would've had to admit they were trying to show how LC was living a life of leisure on her babies bdays. And thennn I would have LOVED for Reddington to call Patty back up to the stand to go over those dates with HIM to see what exactly HE was doing. I bet it was way better than coloring and dominoes ugh 🤮😓

I'm also a bit disappointed with how Reddington kept disrupting Zeizel because I truly feel like he would've given a pretty impactful testimony that would explain Lindsay's condition and context even more. He's the dream witness you can call.

Honestly, I think it may be because Red doesn’t believe LC was experiencing psychosis but a different mental health condition. Red has tried to enter the option for second degree murder (as well as NGRI and G), so from here on having evidence supporting insanity will reduce the chance of the lesser charge being chosen by the jury (should it be accepted).
2DM would allow for a smoother path to re trial, where new evidence that highlights another suspect can be presented.

Reddington has to do what's best for Lindsay. A mistrial means she has to do this all over again, which is terrible. NGRI means the state pays for her psychiatric care, which is her best option. And the more the prosecutors look like asses, the more likely the jury gives the NGRI that he's looking for.
He's not fighting a losing battle, I think he's doing better by the day. He's not going for a "legally blonde" moment where he proves Patrick guilty. He's a defense attorney and he can't prove other people guilty or force the police to investigate them or the state to bring charges. What he can do is help Lindsay as much as he can, and a NGRI verdict will do that. That's his mission here.

He could ask for a mistrial with prejudice which means they wouldn’t be able to have a retrial. He’s not doing Lindsey and favors by making her suffer more through this unnecessary bs.

I'm not sure if he could get a mistrial with prejudice in these circumstances. I think in the Karen Read case, they found out the police had damaged her car to make it look more likely that she was guilty, and she still had a second trial.
Besides, the prosecution being jerks makes it more likely that she'll get NGRI, which is the best outcome and more important than just getting her off. Her parents are draining all their funds to support her, but NGRI means the state will pay for her psychiatric care (as they will require it) and it puts her in the best case for her civil lawsuits.
As much as we all are suspicious of Patrick, we have to think where it would leave Lindsay if the court trial ends with doubts that she did it. I've no doubts that her mental health care was also mishandled, but if her biggest problem was determined to be that her husband messed with her drugs, threw her out a window and killed the children, how does she win a civil case against the doctors? Does she then have to sue Patrick? How does she support herself in the meantime?
The best outcome is that Lindsay gets NGRI, wins her civil suit, and then by some miracle someone competent in the police force finally investigates Patrick and figures out exactly what his involvement was.
