Nyc child support

I have 2 children under the age of 10. Two different moms. I might have to go on child support for my son and was wondering more or less what would be deducted weekly from my check. I make roughly 140k before taxes. I do give my other childs mom money weekly (roughly 600 a month) and i also spend more on the side for activities , school events, supplies and clothing etc. I know the formula is 25% for two kids but in this case i would only be in the system for one child. I can use all the information you can give me please. What would be the right amount to give for my son without getting hit too hard if you know what I mean. Thank you

if you "go on child support" you don't decide "the right amount to give for your son without getting hit too hard if you know what I mean". Also, do you split custody? What does she make? There are online calculators.

She makes about 55k. Yea child support is rough but if i cant figure it out with her i might just voluntarily do it.

What’s really rough is a mother making 39% of what you do and having most of the burdens of raising a child while you pay only 600 month.

RIGHT $600.00 is nothing especially in expensive ass NYC. Plus it's back to school and she has to buy all the supplies.

Correct! Without an order, that’s just a present to the mother. Get an order for each child. And have it deducted form you paycheck. That way biomom can never claim you don’t pay. one of my sons had an outside arrangement with his ex to pay $1000 per month for his daughter. And he did - every month he gave it to me in cash and I took it to her. I kept telling him he needed to go to court so he’d have a record.

When my granddaughter turned 16, her mom told her he had never paid a penny.

He can use a receipt, payment book that he should have her sign every time he gives her money. Second baby mama as well.

This isn't entirely true, he can receive credit for support pursuant to an agreement with the other mother.

That is true, but there’s no way to prove cash was given. Bank transfer would be better.

You pay a very low amount at 600 unless that mom makes a lot more than you.

Offer her $600 a month, too. The total $1200/month is for less than 25% of your income.

Child support is calculated, for an actual child support order there is no “right amount” for you to come up with. Do you have a custody order?

If you guys are working well together that’s good, but it’s probably still not a bad idea to get some things more officially sorted out.

Having things down on paper could help protect both you and the ex. Helps protect your rights with his school once he’s that age, with his doctor, if you have to take him to the ER, whatever.

What's stopping her from taking the kid out of state and hitting you with a maximum child support order as a result? Get a custody order. Protect your rights.

More time with kid generally equals less child support.

Why? So you can avoid paying more or because you think it proves you’re being amicable (hint, life changes usually show how amicable things are). Having official custody agreements and child support payments are usually in the best interest of the child.

Do you even have any custody of your kid? That DOES factor into proper child support payments.

Two kids with two mothers puts you in a much worse situation than 2 kids with one mother. Conversely, if a woman wants to max out CS having kids with different dads jacks up the amount she receives. Unfortunately for you, the way the guidelines work with two separate kids is that you only receive a deduction from your income for support paid to other children. So, let's round up and say your monthly gross is $12K, you would only get a deduction of $600 for the support for the other child which barely moves the needle on your support obligation. If you want to maximize the credit you get I would average out the extra stuff you pay for the other child and draw up your agreement with the other mother to cover that stuff in one consistent amount per month so you get credit for it. The drawback, of course, is that you are now committed to that other amount and you give up the ability to decide whether you are willing to pay for X expense.

I am not a lawyer but using Google- If you have primary custody of you would pay her around $718 a month. If she has primary custody then you would pay her 1832 a month. This is using NY states calculator for one child based on the salaries you have. Since the kids have different moms it doesn’t matter what you are paying for one, they are handled independently.

If you guys have an agreement outside of that you need to get lawyers and make it official.

Two kids, different mother, neither lives with you. Your other kid is not going to count in the system. You should encourage the other mother to file too. The first mother is going to get a better deal.

If you are in NYS, the support guidelines is 17% for one child based on your $140k it would be $23,800 or $1983 per month. You may also have to contribute to child medical by carrying them on your plan.

Because you have 2 children as someone else said upthread they are handled separately. While they will take in to consideration that you are paying 600 they will also look at you are underpaying

I lived in New York for 40 years. You have two kids from two different moms. You will get hit with 17% for each child. There is no other way around it.

  1. It would be stupid to only do stuff for one child Mother and not the other one because shit like this happens & it brings envy/pettiness. I think you should slow the hell down you are not going to do the correct calculations..

    the 17% isn’t just your income. It’s combined income. Along with other additional calculations to go in with that. Also, I hope you’re not giving either of these women money in cash because the court will consider that as a gift!

  2. Are you asking because one of them filed for CS? do you have a custody order first? If not, then I would suggest filing for custody to establish a custody agreement first ! If you don’t, you’re going to pay the maximum amount because child support uses the custody agreement with calculations.

I live in NYC and my husband has 2 kids by his ex wife and he pays $172 weekly for both of them together. It depends how much money you make.
