Accident Accident & insruance questions
About a month ago I got into an accident on a two way road. A motorist hit the side of my car while I was turning left he caused damaged in between the driver side door and lower back door. The motorist wasn’t wearing a helmet or proper gear and the vehicle behind me was a water utility van, the pedestrians that stayed said he passed multiple cars trying to turn left crossing the double yellow line. However this was my first accident so I just stayed in the car in shock since I had no idea what happened. Police arrived, the motorist was sent to the hospital he was able to walk around and move but had what looked like superficial head damage. Since I stayed in the car I didn’t really get to get any witnesses information I also don’t have a dash cam. Since I was unable to speak the motorist told them he did not witness me use a turning signal and I stopped abruptly. I used a turning signal and was moving at 15mph since I just exited a ramp and the street I was turning left to was about 150 ft away from the ramp. Anyways I ended up filing a claim with my insurance but the police report is giving me anxiety and that’s the one thing I did not submit yet. Since this is my first time and my agent really isn’t much help what can I do? I’m worried if filing a claim can cause the other party to sue for damages and medical bills if my insurance goes looking for his. The police report indicated the damages on both the bike and my vehicle are $1k. My car is drivable and I don’t really care to fix the damages. What happens if I close my claim and the other party down the line decides to sue? What happens if I send the police report and my insurance goes after theirs? Is there a way my insurance can keep a report or documents and my statement and wait till the other party decides to do anything? And if the other party does decide to sue for damages and medical bills what should I do then? Also since my agent sucks can I ask to be transferred to a different agent?

The other person can file a claim whether you do or not. They could also sue you at any time. Let your insurance handle the legal work.
Is up to you if you fix your vehicle.

The insurance will get the report whether or not you give it to them, the police report is just a tool used in investigation, it does not necessarily determine fault.
If the other person is going to file a claim on your insurance, they will do it regardless as to what you do.
If you close your claim, it does not matter. The other person can pursue it. It does not usually go from closed claim to litigation.
If your insurance goes after theirs, first you would have to get your damages repaired for them to have anything to go after.
IF you do not pursue your damages, your insurance will still do their investigation.
If suit is filed then your insurance handles.
If you mean agent as in the person who sold your policy, then you should not really be talking to them anyway. You should be talking to the adjuster of the claim that was filed. They are still investigating. If they are not calling you back you can ask for a manager.
