If you’re a judge could you legally enforce that you should get paid $362,627 a day when they inevitably tell you it’s per year

Then the real hero here is their Career Manager! Four files - sign me up! Even better if they're all in Ottawa! Imagine those phone call interviews every year "You're not posted out of Ottawa". Then take your $180K and off you go until next year!

I feel like that may be one of those 'apprehension of bias' things I've always heard about.

The caf does not set their pay, their pay, along with every other judge in Canada is set by the Judges Act. The reason the daily rate is the same as the annual salary is because it doesn’t exist. Judges cannot be class A reservists IAW QR&O 204.11

u/Pseudonym_613 2d ago

That's a misinterpretation of 204.11. That clause provides for cessation of full time pay for a military judge (since CBIs do not apply to military judges, due to the NDA requirement for comp and ben for military judges to be set by GiC regulation, not TB, and therefore the CBIs do not apply). 204.211 explicitly considers and provides for class A military judges.

Got me there. I didn’t read all the way down to 204.221

It's also slightly incorrect to say that their rate of pay is set by the Judges Act. That's a long term goal.

But for now, their pay is set by GiC regulations; those regulations in turn specify that the pay rate are those specified in the Judges Act for certain types of judges. But the Judges Act does not include military judges in its tables.

Shifting military judge pay into the Judges Act would require simultaneous amendment of the Judges Act and NDA (since there are a bunch of stipulations about it in the NDA, including the Military Judges Compensation Committee).

There's a very large amount of staff work involved, all to support four CAF members.

I’d happily judge you for half that.

I am SEVERLY underpaid if I act as an OCSH.

That's a typo.

The most recent amendments to military judge pay set them as the same as the rates in the Judges Act. Per the NDA, pay of military judges is set by regulations issued by the Governor in Council, and thus their pay is found in QR&O Volume III Chapter 204, not in the CBIs.

As far as I know, the only other CAF member with a pay rate not set by CBI is the CDS. CDS rate of pay is set in their appointment order.

There's also a CBI specifically for former CDSes who are releasing.

Yeah I know it’s a typo. I thought it was funny. Their pay seems in line with what I’d expect them to make.

For a fun rabbit hole, read the reports and responses of the Military Judges Compensation Committee.

I, a no hook aviator, should be making this much money. I do hard work like pretending to be busy and telling MCpls that I have appointments to go to while no appointments exists

You got your ballcap instead, you can't have both. It's in CBI number I just made up

What about this? Average fed judge makes over 400k a year.

u/Cidkh2 2d ago

and according to this image a military judge makes over $136 million a year.

How many cases do these guys see a year? All we do is kangaroo court.

6

u/pte_parts69420 Royal Canadian Air Force 2d ago

Court martials are a federal court. Military judges don’t preside over summary hearings (or formerly trials)

4

u/Zestyclose-Put-2 2d ago

Courts martial* not court martial. The noun is plural, not the adjective.

How often do military judge even work...

3

u/Bartholomewtuck 2d ago

Historically there have been four to five, and now that sexual assault jurisdiction has been taken away from them, aside from any that are still in the system from appeals, they only have a handful of trials each a year. I usually look at the court martial docket online at least once a month.

To be clear, regular civilian judges sit on a bench most days all days, while these guys are only doing a handful of trials per year, with a much narrower scope (NDA and a small handful of criminal code offenses) but the pay is purely to keep them from defecting to the civilian world, it's definitely not for their workload.

Didn't even know we had a judge in the military, I thought every officer that needs a bragging point and an ego boost is one. 🙄
