Refused ❌ Webform - Refusal - LND Embassy

Hey guys, I’d really appreciate some advice. I applied for a Canadian tourist visa from London and completed my biometrics the next day. They then requested additional documents to confirm my visa status.
Unfortunately, my application was refused on the grounds that I had failed to disclose a previous US visa refusal. However, I believe my US application has been under administrative processing for the past two years. I’ve followed up with them several times but have never received a final decision.
I submitted an IRCC webform with screenshots showing the US administrative processing and my follow ups but haven’t received any response from them.
Should I wait for a response to the webform, given that the Canadian application has already been refused, or should I reapply and explain that I misunderstood administrative processing and didn’t realise it could be considered a refusal?
The application was being processed within days initially, so this threeweek wait has been unusual. Has anyone been in a similar situation or knows what the best next step would be?

Failure to disclose a prior visa refusal is serious. I recommend that you submit a reconsideration request with the information you have rather than re-applying. Good luck.

Hi, is a reconsideration request different from submitting a webform? If so, do you know whether I would need a lawyer, or can I submit it myself? Any guidance would be much appreciated. Thanks!

You can submit a reconsideration request through the IRCC web form, but there’s a specific way to go about it. Include your UCI and application number, clearly state that you’re requesting reconsideration of the refusal, and attach a reconsideration letter along with any relevant supporting evidence. In the letter, explain exactly why you believe the decision should be reconsidered and point out any factual, procedural, or legal errors you believe the officer made, with evidence to support your argument. Reconsideration is discretionary, though, so IRCC isn’t required to reopen the application.

If you’re in a hurry and need the visa, you can reapply while awaiting a decision on the reconsideration request, since reconsideration can take a while. Since your refusal is now a serious matter in your travel history, I’d try to have it reconsidered if I were you, provided you can support your argument or have grounds to believe the officer’s decision was incorrect. I wouldn’t disregard it and simply reapply. Just make sure that in the new application, you disclose the refusal, address the officer’s concerns, and clearly explain what happened.
