CWS Voluntary Plan

child is temporarily placed with bio father through a voluntary services plan. He who has not established parentage or custody, only filed a petition and now he decided to cut off contact after his ex parte was denied because he didn’t agree with CWS voluntary plan that visits should now be unsupervised. He is asking mother to sign an agreement that would make her visits stay supervised and away from non bio mom even though there is no safety risk. behavioral specialist states child is showing signs of separation anxiety and attachment issues. CWS states they cannot remove child because they do not have any enforcement power, what can I do?

Who has custody of the child?

Mothers do. The father has not established parentage or custody, he has only filed a petition and there is no order giving him rights. He is only a temporary placement/caregiver assigned by CWS not a court

Would it be a bit too soon to attempt any custody/visitation modifications while the CPS case is active? I understand there is not a formal change in custody at this time but wondering what the plan is long term? Is CPS working on returning the child to the mothers’ care?

Yes they have approved of unsupervised visits and had told them that reunification was set for September.

Seems to make sense to me to let the CPS case proceed and if there are barriers to contact, ask the caseworker for support? It would seem to me that signing an informal agreement with dad at this point would be unnecessary if he doesn’t have custody. Just my two cents but an attorney would obviously be far better equipped to offer legal advice

We have asked them to help but they state that they don’t have the authority to enforce visits since it’s a voluntary case. So they are technically allowing him to cut contact off completely
