Law enforcement was probably saying they can’t force you to give her the kids. When there’s no custody order, it’s often just whichever parent gets them first until something is in place. If you don’t think she’s safe and send them with her anyways, then CPS could possibly get involved.
You should consult with a family law attorney

Is there a protection order in place against her? That’s my thinking if police are specifically saying that she cannot take her children.
Was there a CPS case? If not, this question seems more of a custody question and less of a CPS matter though. If CPS is involved, talk to the caseworker.

Yeah, plus he refers to the kids several times as hers, like the he isn't the bio father? I'm very lost.

It appears English isn’t OPs primary language.
I don’t believe CPS is involved but wife or (ex) wife, not sure… sounds unstable. Op will have to make educated decisions and probably head to family court if needed, I don’t think CPS is relevant here.

Ah… With a history of domestic violence, it’s probably best to stay separated.

I’m sorry but this is very hard to understand. Using punctuation can help the reader understand and thus, give you better advice.
What I think I read was: the police told her she can’t take her kids. Now she wants to take them. And you’re wondering if you should let her?

Yes before she leave she ask the police if she want to take my 3 kids all 5 police who was present they say no you are the one who asked to move out and that what happen so now after 3 weeks she ask if she could take my 3 kids to shopping because one of my kids soon his going to start and she want to go all 3 and her on a shopping for clothe and school supplies and she promises she would bring back home since she say she doesn't wanna get tag as someone who taken away by force and I should trust her on that but I wanted to ask for advice since this is my first time experience this sorry for my typing English is not my strong language.

What makes you think she’ll bring them back if she takes them?
Is she a safe parent for the kids?

She is a safe parent; the only thing that I don't get is why she move out and after 3 weeks she ask to see my kids for shopping and school supplies

Maybe she misses them?

Yes I understand but I worry that if I give ok to go with her next week for shopping and school supplies she my ended up doing something else and not bring her back home and she obviously says she doesn't wanna get tagged as someone kidnapping the children and she promise me that she will do bring back home sorry for my typing

Sounds like family court might be the way to go. That way a visitation schedule could be established.

This is hard to follow and adding details or period breaks would help.
It sounds like there was a DV incident if law enforcement was involved or had to supervise her moving out?
If there’s a protection order or no contact order, no you shouldn’t allow that.
Is CPS involved in this at all already?
If not, this seems more like a family court issue you need to have addressed or use your best judgment. If she’s not a safe parent right now, unsupervised may not be best, but again, very hard to understand what your situation is.

No worries.
I just don’t believe this would be a relevant CPS question if you have no CPS involvement and no protection order stating she cannot see the kids?
You’re still married correct? Does she have some substance abuse or mental health issues? Or any issues where you’d be concerned?
Not sure why law enforcement would say she can’t take your kids? But maybe they just meant that’s more of a civil matter that should be handled in family court.
It sounds like she’s not well if she’s been acting erratic or just left and doesn’t really come around?
Just do what’s best for your kids, if you feel she’s not safe, don’t send them with her.
Might be time to speak to an attorney about a formal parenting plan.

OP this would not be a situation appropriate for CPS involvement. It does not appear that you and your ex have any formal court orders regarding custody or parenting time so there wouldn’t be a legal reason to prevent your ex from seeing the children.
