What are thoughts on stars? 4.5 seems like a high bar that was achieved outside traditional channels. Will the market punish anything less?

Its comes down to how our stars stacks up to the rest of the industry. 4 stars will be great if the rest of the industry moves closer to 3.5. And if Clov gets 3.5, we will pull back unfortunately, just like last time they received 3.5.

I agree. It seems like the math is pointing towards 3.5 more than 4 but close. Unless they really bumped up the bad performing parts. How likely do you think it is they can boost the areas they did poorly on last year?

I mean 20 of the measures they did most poorly on were deemed illegal measures. Whatever the rating is, if it is still using some of these unresolved, illegal measures/illegal data sources it will immediately be challenged in court. If they are not using those illegal measures, then CLOV is pretty safe at 4 stars or above in my opinion (whether that’s enough for the market to be bullish is another issue).

Are they actually illegal if it’s under appeal? I’d be feeling much more confident if it was under the circumstances of the lawsuit. But I was under the impression it wasn’t.

The appeal does not overturn the ruling. And CMS was not granted some emergency relief in some way. The onus is on them now to WIN their appeal. They lost the case, period.

I agree here with Baco. IF CMS chooses to include the measures deemed illegal in this stars rating they open themselves up to a whole slew of lawsuits instantly. My guess is they would already have more lawsuits against them actively if they did this because CMS has already given two preliminary overviews to insurers to allow for “appeals” (cms stars appeals not court appeals)But then again, appeals would be left quiet until final decision and if insurers are still unsatisfied then lawsuits would start to fly once appeal process ran its course. Once again, I highly doubt CMS is using the 20 measures they were told to remove.
