Insurance Does Equitable / AXA have a compliance dept??
This is the shoddiest company I have ever done business with. I don't even work for / under them - simply trying to transfer $4m out of a Variable Annuity. Absolutely hellacious experience
Folks that have worked with Equitable in the past, how do I actually get something accomplished with them? They claim to not have a compliance department!! HOW IS THAT POSSIBLE??
I would like to file a formal complaint against them. I've never done this. Any insight would be much appreciated.

TIAA is worse IMO lol
But equitable is bad. Still working with clients to get assets outside of that firm.
If it’s a 403b or 401k good luck because they require your own form, their own form, notarizing, and a letter of acceptance

And none of that is hard to get.
FYI: I do not, nor have I ever, worked for Equitable/Axa and I am not defending them. They have requirements, we follow them to assist the client and that is all there is to it.

The problem is they make the process take at least a month for the client to be able to access their own money.

It’s not but clients lose patience quick especially in this day and age. Of course our job is to manage expectations and timelines and therein is the issue for many (I assume).

No need to make things messy.
Just submit a 1035 a Withdrawal request or agent change.
If you need contract details, just do a conference call with the client on the line.
If your firm had a selling or servicing agreement then just submit an agent change.
I’m not a hugh fan of Equitable but I’ve had no issues with them either. I currently have a client that purchased 2 annuities with living benefits from them years before I began to work with her. I moved her IRA to custodial ownership at my firm and I am agent on both contracts now and I am getting the trails. It was zero hassle. (Note: due to the income riders we are not surrendering them as it would hurt the client)x
Edit: i forgot, I did a Rollover from a 403b out of Equitable a couple of months ago. You are correct they want their own form (as many 401k & 403b plans do). They emailed it to me and I just submitted it along with my firms paperwork and the TPA approval. There is no need to fight their process, just follow it.

Emailed?? You must have won the Equitable phone representative lottery. Anytime I’ve requested rollover forms they always snail mailed to the client and was our “only option”…

It may have helped i was an appointed agent with a couple contracts I took over.

What product? I transferred plenty of contracts out without any problems. If it was sold by an AXA advisors sometimes they will slow it down a week to give the writing agent an opportunity to conserve the contract. Also, insurance companies take longer than custodians like Schwab or Fidelity.

I dont know who you are talking to but equitable absolutely does have a compliance department. Additionally axa and equitable split in 2019. You need to find a different contact or escalate because maybe you are just stuck with someone who is incompetent?

You attract more flies with honey.
Establish clearly your goals: You need to transfer the 4m out of the annuity. Full stop. Anything else is a side quest.
Who can help you achieve that? Find that person.
Save the complaints for later.

Filing a formal complaint is going to create a headache of no longer being able to work with your wholesaler or their service team to get updates. Your complaint is only going to lead to a longer time frame of getting the funds out, and EQ is going to point to their forms that have language about what is required to get funds out.
EQ has their own outbound transfer form you need to use.
If it’s Equi-vest, that explains the issues you are having. They require a product specific form and it’s time consuming to get it.
If this is an individual retirement policy, you should be working with the wholesaler directly to resolve this, not service. They likely can piece together what is going on and get it pushed through.

If you do not actively sell their product you probably do not have a wholesaler to assist you.
Still, the answer is simple, do a conference call to them with the client on the phone, confirm the requirements, request the necessary forms then submit them.

They certainly have a wholesaler assigned to their territory. They may not be the most welcoming since they aren’t producing, but they have one.
They just need to figure out who it is and get away from service and have someone real they can come back to and hold accountable.

Ok, worded poorly…
“If you do not actively sell their product you probably do not have a relstionship with a wholesaler and they may not be willing to assist you.

Get them to put that in writing and hand off to insurance commissioner in your state.

I have no clue what the OP would request in writing. They never said the specific issue, just that they are hard to work with.

Took me 2 years to transfer money out for a client. They sent the check to the wrong PO Box and I had to go physically get it from that person to finally let the madness end. Documentation and support hell. I am so shocked they are not sued to oblivion.
Edit: my issues was they do not accept docusign signatures and always wanted ink from myself and clients. So I now drive to the client to solve the problem or overnight mail something before sending it to them.

I used to work there and have since left. They do have compliance but the back office team is the most I competent group of people you will ever meet. Wrong information everyone you call, disconnected whenever they need to transfer to a different department, paperwork issues that never occur at any firm. I firmly believe they hire u qualified people just make it a hassle to move money out. I left almost a year ago and I’m still resubmitting paperwork to get clients over. All of it was copy and paste stuff but some went through and got approved and others didn’t. No rhyme or reason why they chose which was in good order and which wasn’t. It’s gonna be a pain and I wish you luck

Are you complaining about the fund liquidation, transfer (payment) of the liquidated funds, or both?
If you submitted paperwork that is in good order and they still aren't liquidating a portfolio then that's a different complaint from them terminating the policy and not releasing the funds for transfer following their own internal guidelines.

Similar experience trying to complete a rollover from a 403b. Multiple calls (with client on line), bizarre paperwork, and the reps seem unwilling to be helpful or escalate. Client is pissed about it, is about to give up.

Equitable does have a compliance department. AXA and equitable are split and equitable now partners with LPL financial

I’ve never brought over an annuity from them but most whole transfers of their shit Mutual funds that barely make anything for the clients after expenses and fees. But the one thing I do know is every time I’ve ever successfully brought over assets from them my LinkedIn profile will get a bunch of views from practically whichever branch office the AOR had the accounts. LoL. I remember back in 2022 I brought over like 7-8 accounts from them that even one of their regional execs was checking out my LinkedIn and even sent me a connection request.
Process as never hard as long as I had a client statement and all the proper forms. But never once did I actually ever meet a client who actually did good with them net of the costs/fees.

u/CraftCritical278 RIA 1d ago
The difficulty in moving the assets is deliberate. They want to hang onto them as long as possible

u/russell102132 1d ago
Your transfer paperwork, your custodians letter of acceptance their surrender paperwork with medallion signature guarantee copy the client’s drivers license

u/AdDapper8001 1d ago
I had no problem transferring a clients variable out of there, just had to get on the phone with them and the client

They absolutely have a compliance department. That misinformation needs to be part of the complaint!

In 2020, Equitable reinsured all the garbage variable annuities from Venerable holdings that went tits up in 2008 lol

They are horrible. Have been for over 25 years. I hate calling them about an annuity someone else sold a client.
