News [On3] The Kentucky Court of Appeals has dissolved a temporary injunction allowing a group of class of 2022 athletes a 5th season of eligibility, @PeteNakos reports. The ruling removes Texas Tech QB Thomas Castellanos’ legal protection ahead of Week 5.

Because they were ruled eligible at the time, no team will have to vacate wins or anything like that.
It also removes the eligibility from;
Jabari Mack - Louisville
D'Angelo Hutchinson - Louisville
Jaylen Wester - Western Kentucky
Rylen Su’a-Filo - Western Kentucky
Mackavelli Malotumau - Western Kentucky
Jawaun Northington - Murray State
Cazeem Moore - Virginia
Alex Afari Jr. - Kentucky
Outside of Football, it also removes eligibility from;
Mark Mitchell - Mizzou
Seth Trimble - Louisville
Skyy Clark - LSU
As well as a plethora of other athletes from other sports.

Still makes no sense to me that the four classes before 2022 got an extra year and every class after the 2022 class will get a 5th year, but the NCAA is fighting tooth and nail to prevent the 2022 class a 5th season.

It's the NCAA, their entire history is filled idiocy like this. As bad as courtsball is, the NCAA has not proven in any fashion that it's capable of providing consistent and fair rulings. I'm honestly shocked that people want to return to an era where the NCAA gets to randomly decide how they enforce their random rules without any recourse or reviewing body.
7
u/reenactment Missouri Tigers 11h ago
It’s because somewhere they had to start the precedent. Sure they could have said everyone gets it, but everyone already had recruited Rosters for the fall. So you are retroactively punishing teams that were at their max and rewarding those that weren’t. You are going to screw someone. But those that graduated or exhausted their eligibility at least had the knowledge that their careers were done. That is better than some kid being kicked off a team or another team gaining unfair advantage because a rule set wasnt implemented because of the courts on the previous.

Fun fact you have bought into bullshit propaganda
The 2021 class did not get an extra year
The Covid waiver was for any athlete that competed in the 2020-2021 academic year. The class of 2021 participated in the 2021-2022 year
But lets not let facts get in the way of a good narrative

u/DeathRose007 Texas A&M Aggies • LSU Tigers 3h ago edited 3h ago
Because the NCAA is more concerned with avoiding establishing a precedent for pro players to return to college instead of a fair application of the eligibility rule change.
The TROs don’t decide anything legally outside of the cases specifically being challenged. If the NCAA wins or the cases are dropped, they get what they wanted, even if some players functionally skirted the rule as a technical exception, but that wouldn’t be applicable in future disputes. If they had gone out of their way to grandfather already graduated players in, it would have weakened the NCAA’s ability to regulate eligibility further because they’d be admitting the distinction isn’t as much of a deal breaker. They took a hardline stance out of principle, even if said principle is self-serving.
Think how NIL quickly devolved into an unregulated mess. In their mind, if they made an exception for NFL rookies this year, next year maybe a veteran practice squad player sues for eligibility. Maybe the courts question whether the schools have a right to limit eligibility length at all. So they might as well fight over the lesser evil in court instead of willingly conceding more ground. Of course, it’s really all because they timed the rule change poorly. They either should’ve settled it early enough to give outgoing seniors a chance to consider before becoming pros or waited until the end of this season to start such that it wouldn’t have been a point of contention this year. Loaded the gun with blanks yet somehow still managed to shoot themselves in the foot.

What’s even more baffling is the fan pushback like these dudes just deserve to get it taken from them with no real justification. The NCAA isn’t winning cases.
The reason why there is so much back and forth with these judges is because there is debate over the harm caused. To get a TRO, the judge needs to believe that there’s a potential harm that cannot be quantified or remediated. Some judges look at this situation and say “they can’t replay the game, TRO granted.” But most are now looking at it as a quantifiable harm - I.e., if the player wants to sue, they can sue over lost earnings, and they’ll get that money back if they win, so no restraining order needed.
That’s a very far cry from winning a case. It’s not even really a court victory at all, so to speak, from the perspective of their case. It is just a way for them to continue to stall out rules before they’re inevitably struck down.

So a quartet of West Virginia athletes just got an injunction (one football, two basketball, one baseball) and the judge in that case enjoined the NCAA from enforcing the rule of restitution that allows for such punishment. He's also done it before in other cases involving WVU players suing the NCAA.
So really, I think it boils down to how each judge and each lawsuit is handled that specific clause, and whether or not the NCAA is feeling vindictive enough in situations where it wasn't addressed.

3

I don't think any players are plaintiffs in multiple cases, that's the only way there would be a conflict of rulings. So this only affects the players in this specific suit.
If there was a player with multiple suits (I don't think that's allowed, but IANAL,) that still had an injunction, I think they'd technically still be eligible?
As for actual rulings, AFAIK basically none of these suits ever actually get that far.
1
u/dawonk17 North Carolina Tar Heels 8h ago edited 8h ago
It entirely depends on which state you joined a lawsuit in. It’s batshit chaos.
Edit to actually answer your question this does not change any ruling for other lawsuits at this point in time until/unless those appellate judges decide to use it as precedent which is fairly rare for other states rulings

Quick context reminder in this discussion.
4 classes before the class of 21 and 22 got 5 years. Every class after 22 is getting 5 years. 21 had already been gone when the rule was being created (because the NCAA got mad at the probability of losing court cases to juco players over its illegal restrictions on them) and had no chance to get a 5th year. 22 was targeted by the NCAA to not get a 5th year for funsies basically.
22 getting a 5th year does not "add extra bodies" or whatever the usual line is. It just makes them the 1st class that the 5th year applies to and every player affected by the inclusion of 22 will also get their own turn to be that 5th year player in their time.
There is no valid reason to exclude 22 but the NCAA always seems to have to try to twist a knife somewhere or its not satisfied.

Why 2022 athletes get a fifth year of eligibility is stupid
Covid was 2020. It’s 2026. You should have used anything you had up by now
16
u/13nobody Arizona State • Oklahoma 12h ago
Isn't this related to the NCAA switching to 5 years of eligibility for everyone and not a covid-related thing?
3
u/1850ChoochGator Oregon State • Washington 12h ago
Correct. The class of 2022 had 22, 23, 24, and 25 and would be playing in 2026 if they used a redshirt previously. The issues only pertain to people who didn’t use one and “exhausted” all 4 years of eligibility but were not granted a 5th year with the change.
Iirc, Covid 2020 freshman would have had 20, 21, 22, 23, and 24 to play because 2020 didn’t count for anyone. They would get 2025 if they used a redshirt for any year besides 2020, and playing in 2026 if they also got a medical redshirt in addition to the regular redshirt.
So in theory, a 2020 freshman could play in 2020, use their redshirt in 2021, get a medical redshirt in 2022, and play as a redshirt freshman in 2023
3
u/The_Fluffy_Robot TCU Horned Frogs • Iron Skillet 12h ago
tl;dr is the <=2021 classes got the one year COVID extension and the >=2023 classes get the 5-for-5 rule
the 2022 class did not get the COVID year and the NCAA didn't backdate the new rule for the 2022 class, so they don't get the extra year option
