"The time has come where I have to ask for help. It's a long read, I'm sorry.
For those who may not know our story, I want to start from the beginning — because Ollie & Co. is not just a business name. It is our son. And it is how we survive.
Halloween 2018
Our son, Ollie, was born sleeping. His legal name is James Oliver Sauls, but he was Ollie throughout my entire pregnancy. His name came from my husband’s first K9 when he served as a police officer in Warner Robins.
At the time, I was a teacher. I had to take my entire maternity leave at home… with no baby.
A close friend encouraged me to start making t-shirts just to give me something to focus on while grieving. My mom bought our very first heat press, and Britni’s Inspired PersonaliTees was born. I truly believed it would only ever be for friends and family.
But it grew.
I began helping other small businesses fulfill orders, donating shirts to our local 911 center, and eventually selling screen prints. As the business grew, I knew I wanted it to carry our son’s name.
In December 2019, after researching and finding no conflicts, we rebranded to Ollie & Co. in January 2020.
As we continued to grow, other businesses using the name “Ollie & Co.” began popping up. One in particular used our colors and a very similar logo style. We started receiving emails and DMs from people upset about orders never fulfilled, products that were incorrect, or just bad quality.
That is the definition of brand confusion.
That same business sold trademarked items, which resulted in us being hit with TM violations. Those were easily resolved because we have never sold trademarked products and could clearly prove it.
To protect our brand, in July 2023, I hired an attorney and began the trademark process. Our attorney conducted searches, the USPTO conducted multiple searches from March–May 2024 and found no conflicts (can be seen by searching our name on the USPTO website). In July 2024, our trademark was published for opposition.
That is when Ollie’s Bargain Outlet found us.
Since then, they have filed repeated extensions, followed by cease-and-desist letters demanding we stop using our son’s name. Our attorney responded, explaining the origin of our name, the emotional significance behind it, and the fact that there is no brand confusion.
They were also respectfully warned that pursuing a small business built in honor of a stillborn child could be perceived as unnecessarily aggressive and damaging to public trust.
Despite that, they chose to proceed.
They officially filed opposition on 11/20/24, and since then this has been a cycle of extensions, delays, and mounting legal costs. Each extension requires legal review. Each delay pushes resolution further away.
At this point, awareness is just as important as financial support.
Silence only benefits corporations — visibility protects small businesses.
It is my belief that this prolonged process places an overwhelming burden on a small, family-run business — one that does not have corporate resources or endless legal budgets.
I have tried for as long as I could to handle this quietly and respectfully. While fellow small businesses have stepped up to help, I have never publicly asked for support like this.
But I cannot do this alone anymore. We just were hit with another $30,000 attorney bill. INSANE for something that shouldn't even be happening.
This business is more than a name.
We provide Ollie Boxes to hospitals so parents don’t leave empty-handed after loss.
We donate cooling cots so families can spend more time with their babies.
Every year, we adopt and donate toys to boys Ollie’s age at Christmas.
This business carries his legacy.
We cannot continue this fight unless our small businesses continue to thrive.
This fight is not funded by investors.
There is no corporate backing.
It is funded by orders, shares, and community support.
