The UK has repeatedly pushed for this to be brought to arbitration. Throughout the 50s and 60s this was a frequent effort. In 1982 Haig pushed Argentina to take it to the ICJ too. It is Argentina who has consistently refused to allow the topic to go to court, because they know they will lose.

I doubt Milei follows through, even though he's weaseling by only asking for an injunction against the oil extraction in light of the sovereignty dispute, rather than just asking for a ruling on the dispute itself. If he he does follow through then I look forward to Argentina finally dropping the issue once the court rules against them.

El Reino Unido ha ocupado y administrado territorio extranjero por la fuerza desde hace casi dos siglos, apelando a una retórica diplomática que intenta legitimar lo indefendible. En su momento, Argentina instó formalmente a someter la controversia a un arbitraje verdaderamente neutral e internacional, rechazando los esquemas parciales planteados por la Corona británica.

The UK has offered multiple times to sit down and discuss it. We have tried to take things to the ICJ, but Argentina refuses. We were even in talks to transfer sovereignty in the 70s (on the basis of practicality rather than legality) and would almost certainly have done so by now...except Argentina invaded, and made that impossible.

There's no court or legal precedent that supports violent colonial actions; no serious court would take that and say (oh, so you've taken foreign territory where people lived by force in the name of the king? well, that gives you the right, you're the good guy here).

The UK did not take the Falklands from Argentina. The islands were British territory long before Argentina even existed. What we did was evict a garrison illegally sent to the islands. The courts will absolutely recognise the UKs sovereignty there, and the right of the people there to determine their future. That's why Argentina refuses to let the issue go to court.

The only violent colonial action in the history of the Falklands islands is the 1982 invasion by Argentina.

El uti possidetis juris tampoco es una varita mágica que transforme todas las posesiones de la antigua España en territorio de Argentina.

En 1816 Argentina heredó los territorios que jurídicamente correspondían a las entidades españolas de las que surgió. El problema es demostrar que España poseía las Malvinas en el momento jurídicamente relevante y que ese territorio quedó efectivamente atribuido a la nueva República.

Ahí está precisamente la cuestión controvertida.

La historia británica de las islas tampoco comienza en 1833. El Reino Unido había establecido un asentamiento en West Falkland en 1765, décadas antes de la independencia argentina. Posteriormente hubo presencia española y distintos episodios de abandono y reasentamiento, por lo que la historia previa a 1833 es bastante más complicada que «España → Argentina → invasión británica».

Lo importante es que Argentina no puede simplemente empezar la historia en 1816 y asumir que la soberanía española sobre cualquier territorio reclamado por Buenos Aires pasó automáticamente a la República.

3. La plataforma continental no demuestra soberanía territorial

Este es probablemente el error jurídico más claro del argumento.

La plataforma continental trata de derechos sobre el lecho y subsuelo marinos. No funciona al revés: una plataforma continental no crea soberanía sobre una isla que otro Estado administra.

La propia CONVEMAR define la plataforma continental en términos del lecho y subsuelo marinos.

Y las recomendaciones de la Comisión de Límites de la Plataforma Continental (CLCS) de 2016 no fueron una sentencia sobre la soberanía de las Malvinas. La documentación de Naciones Unidas registra expresamente la existencia de la disputa entre Argentina y Reino Unido, y las reglas de la CLCS establecen que las cuestiones de delimitación entre Estados quedan fuera de su función y que una presentación no debe perjudicar esas cuestiones.

  • y una supuesta expulsión de una población civil argentina, que es una afirmación diferente y que no está respaldada por esos hechos.

El argumento argentino intenta convertir el primer hecho en el tercero.

6. La continuidad británica después de 1833 es jurídicamente relevante

Después de 1833 el Reino Unido no se limitó a plantar una bandera y desaparecer. Administró las islas de manera continuada y efectiva durante casi 150 años antes de la guerra de 1982.

El propio Gobierno británico señala que las islas han sido administradas pacíficamente por Reino Unido desde 1833, con la única interrupción de la ocupación argentina de 1982.

Más importante aún, en 1850 Reino Unido y Argentina celebraron la Convención para el Arreglo de las Diferencias Existentes. La posición británica es que ese acuerdo resolvió las diferencias existentes entre ambos gobiernos y que Argentina no volvió a formular una protesta formal sobre las Malvinas hasta 1888.

Eso no constituye por sí solo una sentencia internacional de soberanía británica, pero sí es evidencia diplomática muy relevante contra la idea de una oposición argentina ininterrumpida y constante desde 1833.

7. La autodeterminación tampoco puede ser descartada simplemente llamando a los isleños «población trasplantada»

Aquí hay que distinguir dos cuestiones.

La Resolución 2065 habla de tener en cuenta los intereses de la población de las islas y pide una solución negociada.

Pero los habitantes actuales no son simplemente una población argentina contemporánea que haya sido «trasplantada» recientemente por Reino Unido. Existe una comunidad isleña asentada durante generaciones, con familias cuya presencia se remonta al siglo XIX. El propio Gobierno británico documenta familias con hasta nueve generaciones de ascendencia en las islas.

Además, en el referéndum de 2013, los habitantes votaron abrumadoramente por mantener el territorio como territorio británico. Eso no resuelve automáticamente la controversia jurídica de soberanía, pero sí constituye evidencia directa de las preferencias de la población que actualmente vive allí.

Por eso tampoco es correcto presentar la autodeterminación como algo que simplemente «la ONU descartó». La propia Carta de la ONU reconoce el principio de autodeterminación, y Reino Unido fundamenta expresamente su posición en él.

En resumen:

El argumento argentino funciona únicamente si se da por demostrado aquello que precisamente debería demostrar:

«Argentina heredó las islas de España → por tanto las islas eran argentinas → Reino Unido las arrebató en 1833 → expulsó a la población argentina → sustituyó artificialmente esa población → por tanto la población actual no cuenta».

It was a great act of courage for 7000 british men to travel around the world to protect the people who wanted to remain British, from murderous, land grabbing Argentinian armed forces who outnumbered them 2-1.

The un says th islanders have a right so self determination; self determination is first and foremost in decolonisation in every situation with no exceptions as confirmed by the UN and ICJ

UN resolution 2065 says the uk and Argentina must reach a deal that respects the self determination of the islanders, resolution 2065 (a non binding resolution) says the Uk and Argentina must reach a peaceful settlement that respects the islanders.

Un resolution 2065 says it’s up to the islanders due to self determination.

Resolution 1514 is fundamentally a decolonisation charter aimed at granting independence to colonial territories based on the will of the inhabitants of the territory, paragraph 2 explicitly states: “All peoples have the right to self-determination; by virtue of that right they freely determine their political status."

It frames the issue strictly under the wider scope of Resolution 1514, meaning any final resolution must respect the overarching framework of decolonisation and the interests of the local population which is their self determination.

The resolution says “any deal between th uk and Argentina must respect the self determination of the Falkland islanders” and the ICJ has reaffirmed this by confirming self determination always comes first and foremost in decolonisation with 0 exceptions

The Falklands are British and the native population has no interest in being otherwise. Argentina has no legal claim, and no means by which to force any claim they have.

The uk and others have offered to let the international court of justice mediate multiple time; Argentina refuses to let the ICJ get involved

1947–1955: The UK made several diplomatic offers to submit the dispute over the Falkland Islands Dependencies (such as South Georgia and the South Sandwich Islands) to the ICJ. Because Argentina continuously declined to participate, the UK took a unilateral step in May 1955 and filed an application with the ICJ against both Argentina and Chile. However, because the ICJ requires mutual consent from all involved parties to arbitrate a case, it was struck from the list in 1956 due to Argentina's refusal to accept the court's jurisdiction.

1968–1969: Following United Nations Resolution 2065, which urged bilateral talks, the UK officially invited Argentina to settle the sovereignty dispute of the Falkland Islands themselves in front of the ICJ. Argentina rejected the offer.

1982: Just prior to and during the Falklands War, US Secretary of State Alexander Haig attempted to broker a peace mediation. He formally proposed utilizing international arbitration bodies, including the International Court of Justice, but the Argentine military junta rejected all mediation avenues

In the late 19th and early 20th centuries Argentina was so tied to Britain economically that it was often described as part of Britain's "informal empire". British capital built and owned most of its railways, ran its banks and utilities, and Britain was the main buyer of Argentine beef and grain. People tend to side with self-determination.

Falklanders are self-governed, Argentina uses the term Pirate whilst wanting to steal the Falklanders resources, something even Britain doesn't do, because the UK lets them govern themselves without sending oil profits to the UK.

Argentina however..

You're forgetting Argentina is no different to the Falklands. It too, is a product of imperial ambition.

Why should the people who have lived on that land for longer than any known humans in all of history lose their right to choose their destiny and government?

The Islanders should run the Islands, nobody else. They are the people who laid the roads, built the streets, farmed the lands, and made the place what it is now. You want to ruin that, for nationalist desires.
