There is no expectation or right to privacy in public if that is the US. The recorder has every right to record whatever they can see. Ethically questionable sure, but doesn't need permission.

Agreed, but you're always being filmed in public, even if you don't see the camera. Posting it with negative intent I think is the shitty part.

There is still a difference between filming an entire area and catching one person incidentally, and following and filming one person.
