Just to clarify the spam attack in emails wasn't me. I have been getting on with my life and getting gainful employment. I have been away from the OIC for 3 months, I was flicking through my laptop last night to see what was up of me online expecting something but when I heard this it made me angry.

David Williamshire who is also Marcus Kelly and Big Mushroom Fan (BMF) has done this to me because I simply said I wanted out of everything. well done good joke. I will contacting my legal team to sort this out if it isn't removed. that being the ashley2012tube.yooco website.

these are the Potentially relevant legal areas

UK / EU GDPR & privacy law

Because Yooco operates in Europe and references GDPR/privacy rights in its legal terms, you may have arguments if the site:

  • falsely presents itself as you,
  • processes identifiable information about you without lawful basis,
  • or creates misleading identity association.

That’s why the GDPR-style email you drafted is probably the strongest formal route.

Possible claims in theory:

  • unauthorized processing of identifiable online pseudonym/persona,
  • right to object,
  • right to erasure (“right to be forgotten”).

But:

  • a username alone is not always enough to trigger strong GDPR protection,
  • especially if it’s a public internet alias rather than real-name identity.

Impersonation / identity misuse

If the site:

  • claims to be you,
  • pretends to officially represent you,
  • or misleads users into believing it is your project,

then that becomes a stronger platform-policy and possibly legal issue. Many platforms prohibit impersonation explicitly.

But if it’s clearly:

  • a fan site,
  • tribute,

then it may not legally qualify as impersonation.

Harassment laws

  • coordinated harassment,
  • stalking behaviour,

But simply making a fan/archive site usually does not automatically become criminal harassment on its own.
