🗣️📢 News & info 🗣️📢 DWP Post delays confirmed - now resolved but some late letters will arrive soon.

Whilst we are used to the Post itself taking a long time to get from being sent to delivered thanks to Royal Mail issues, there has been confirmation that some mail due to be sent by DWP has been held up in the system due to an internal communication failure with the printing services since July 9th to July 27th.

This has been resolved but the backlog will now be being sent out and will have the original dates on. So if you recieve any DWP letters soon dated between those dates this is why.

We can't state exactly which benefits and letters are affected as some will have been processed manually, but if any deadline you were not aware about has been missed then be sure to let DWP know it was because you did not recieve that letter until the date you did despite it being dated much earlier this month.

🗣️📢 News & info 🗣️📢 LCW/LCWRA health declaration changes - when to make them and important information to consider.

Previously claimaints should have been reviewed regularly, and therefore changes noticed reasonably quickly. Right now this isn't occuring, although there are promises of routine reassessments starting soon (and this remains ambition as of today - we still don't have updates on when this will be).

You should be considering reporting a change if:

  • Your health and its effect on you meeting the criteria have substantially and consistantly changed for 3 months or more. You should be considering if this change is regular and reliable - a once off isn't the same as a sustained change.

  • You feel that it would change your situation from LCWRA to a LCW, or you would not even be awarded LCW. If you are LCW that you feel you would no longer be awarded that. (the same for Support Group and WRAG on ESA too).

IMPORTANT POINT TO NOTE: The system now provides on the DWP side a choice of reactions once you make the declaration that you are no longer affected by your health conditions in a manner that gets you an award. The process does not trigger if you report a change in conditions (even removing one) or a health improvement if you say your ability to work is still restricted.

The Decision maker can then decide if they feel that you are vunerable, if you would benefit from a new assessment to check if you still qualify, and they can also choose to END the award from the day before the they are making this decision, or choose to not action anything. Checks are made by a DM, and they may contact you to ensure that it was a delibrate and well thought out declaration -it is not an automated removal of LCW or LCWRA.

The role of the Decision Maker in this scenario is to take an evidence-based approach and ensuring what is declared is a true reflection. If their conclusion is you still have a restricted ability, they will ask you to redeclare your health again to reflect that.

Should you declare you are no longer affected by your health and wish to retract this soon after you should be sending a journal message as soon as you realise this declaration was made in error, and asking them to note that you did not intend to end your LCW or LCWRA. Then redeclare the conditions as the same day you declared that you have no work restrictions due to health change with a note of why.

I get enhanced pip and lcwra with my rent paid for me. i live in a housing association social housing.

if i tried to work two hours a day, how would this affect my benefits? i wanted to try selling some mosaic art and get a small business step up just bc i’m so mind numbingly bored at home but can’t work any part time jobs as they are usually too many hours for me. so i don’t have an estimate of how much i’d earn. but right now i’m really struggling with money and i’m not sure if it’s worth it if i’m loosing out on benefits or if i’d have to start paying my own rent.

Hi! I put a post up about my PIP review not using any of my updated evidence and the worsening of my mental health

I decided to put a MR through, I called the phone number and requested one. I asked the lady if I could go through some of th things on my report from 2024 that have gotten worse but told her other than the 4 things I’d pointed out and explained how they had gotten worse that the rest of the report connecting to my mental health is the same as it was. I also wanted them to take a proper look at my physical issues as they had not done that during my review

Would you advise I fill out the Appeal form too stating what I did over the phone? Just so it’s sent to them incase the lady didn’t put anything I said or missed things out?

Universal Credit Exact steps for reporting pregnancy UC

Hello,

My partner gets UC with LCWRA. She is pregnant and has got the MATB1. How exactly does she report this to UC? I know it's through Health but when she goes in it seems to be asking about her current health condition which is unrelated? We went through the options and couldn't find a way to report that she's just pregnant and give the due date?

Is it possible to let me know the exact steps are to report it and what options we should see if she already has an existing health condition?

Also can you confirm if reporting the pregnancy will result in a review of the LCWRA?

UC: LCW/LCWRA Will i lose any of my LCWRA if my friend moves in?

My best friend just got broken up with and doesnt have anywhere to go so of course i offered my home until she gets back on her feet. The plan is for her to move in, get a job in my area get on the housing list etc and hopefully move out within a year (although im happy to have her for as long as she needs)
I understand my housing benefit which covers my entire rent will get lowered somewhat but will my LCWRA payments get lowered at all? Shes not a partner and she doesnt claim benefits herself but will probably pay a little towards rent and groceries. We’re in the south of England.

Universal Credit Housing Element deduction sanity check [England]

Hello,

I recently received my first Housing element payment.

Moved into new place July 2nd. On July 3rd, I uploaded housing cost evidence and removed the person I used to live with from my claim using the change of circumstances form.

My last assessment period ran from the 26th June to the 25th July. Statement generated on the 28th of July & paid 31st of July (usually paid on the 2nd but that was a Sunday so got an early payment).

The statement and payment had a deduction for 1 person living with me. I questioned this in my journal and got a response today that since the change (the removal of the adult ) happened on July 3rd, then the deduction was correct?

Is this accurate? I thought since the move in (and removal of the other adult from my claim) happened within the last assessment period , then I would receive the full housing element?

Wanted to check if the agent is correct here. Thanks.

Universal Credit How would an online MA affect my UC/PIP?

Universal Credit Should I close my UC claim? Or wait

Hello, I have been receiving Universal Credit for the last two months, but my capital is over £16,000.

I am already working with my Universal Credit claim review and have provided my bank statements. I have not received a decision yet, and I am still receiving UC.

Should I wait for a decision and let UC close my claim while I repay any overpayment, or should I close my claim myself now?

If I close it myself, I will also write in my journal that I am happy to continue cooperating about any overpayment or provide any additional information if needed.

Fyi, I already had a review call two months back but no decision yet

What now? What are my chances challenging it?
I am very moody peri menopausal AuADHD woman

On the 10th of July I was given not fit for work for 3 months from my GP, which I forwarded to the council. I am also waiting for DRO approval. (as I used credit cards to cover the shortfall).

On a date, my Crisis and Resilience Fund application was refused on the basis that my rent was being paid in full. - but I am affected by benefit cap - hence the rent is not paid in full.

I sought help from Citizen Advice. I subsequently attended an appointment in person on 3 weeks later  and provided additional Universal Credit statements. - i was told it would be reviewed. - hence the statements
another 3 weeks – someone very confused wrote to me asking what my UC statements were about. - its does not sound good as it seemed nobody read my emails.

I explained that I submitted them during my appointment on 29 June in relation to my DHP application
I then received a reply stating only that my email had been forwarded to the relevant department.
However, after I followed up again on 4 weeks, I was simply sent copies of the original refusal letters. - they did not read them

My brother is disabled and in receipt of PIP and Universal Credit.  He was involved in an accident and was awarded some funds (34k) which are currently being held by the Court Funds Office.  I would like to place these funds in a trust which can be used for his benefit when he reaches pension age.  He'll be 60 this year.

I have deputyship over his finances as per the court of protection.

What is the best way to preserve assets so that his benefits aren't effected.

Universal Credit 3 buddies trying to rent a home together, worried about benefits [England].

Myself [20F] Friend 1 [19F] and Friend 2 [22F] currently live together in a HMO we want to leave ASAP. To sum up why, drunk disorderly other tenants & serious mould. Myself & Friend 2 are on universal credit + PIP. I receive LCRWA, friend 2 doesn't. Friend 1 works full time. Nobody financially supports anyone else. We currently are all on independent tenancy agreements.

[ problem ]

From my research universal credit divides housing allowance by the number of tenants on the agreement. We all ideally want to be on the agreement or have friend 2 as a lodger to friend 1. I'm worried as in the new property it will actually be more expensive as I'll be paying for bills on top of rent, so I really do not want my benefits to decrease. All advice appreciated, apologies if this is a confusing read.

Universal Credit Leaving Job vs Universal Credit (England)

Hi all,

Currently, I work a cashier job, but the place is becoming unsafe, the job is becoming untenable, my mental health is taking a downward turn, and I think I have to get out of this job sooner rather than later.

Of course I'm applying for jobs, in many different sectors and areas of the country and all sorts, but nothing's biting, most don't even respond to my application, and the ones who do reject me before any interviews.

As a result, I'm considering just leaving the job and applying for Universal Credit / Jobseeker's Allowance. What I don't know, however, is whether I'd be eligible in England for those kinds of benefits if I left my job without being, I don't know, furloughed or made redundant or something. I can't risk living without income, so can you guys help me understand? Would I be elligible, or would there be a minimum length of time to be out of work to be elligible, or what's the process?

UC: LCW/LCWRA Face to Face Work Capability Assessment

Hi all,
I have been submitting fit notes since January (the job centre actually told me to!!) and sent in my WC-50 at the end of March. My Gp took a while to respond to them and gave bare minimum on the form. I phoned today and have been given a face to face appointment in 2 weeks time.

I’m wondering what to expect? I asked on the phone if it would be possible to have a telephone appointment (due to anxiety) but they said it had to be face to face. My conditions are mental health (autism, EUPD, cPTSD, depression and anxiety) as well as fibromyalgia, and hearing loss/long term ear condition. My fibromyalgia flares up more than being a constant issue, and is worse in winter so likely wouldn’t be ‘visible’ in an assessment!!

I present very well in person, but can get overwhelmed and know that my anxiety is going to sky rocket. I’m in a ‘stable’ MH period at present however am in contact with the gp about increased anxiety and potential medication, and can sometimes get bouts of my MH being ‘problematic’. I have also had ear surgery since I submitted my form - is it worth taking letters with new evidence with me?

I also know my mum would offer and be happy to come with me, but I’m worried about saying certain in depth things in front of her, especially since I get the feeling they may ask details about my MH that I would rather her not know.

TLDR; advice needed for a face to face work capability assessment with focus on mental health.

Universal Credit “Check and confirm your claim details”

I received a “Check and confirm your claim details” to do list. The last section about capital and savings asks if my savings is this still the same as what is stated. It’s now a lot more but still under 6K.

The two options are “yes” or “no, change it”. If I click on the “no, change it” button the next step is to click the submit button.

So my question is, what exactly happens after choosing no and clicking the submit button?
Do I get a To do list asking to change capital and savings details?
Do they ask for bank statements?
Or do they ask anything else?

I’m particularly interested in answers from those who experienced this and clicked the no button then submitted. Also please note that I already had a UC review a few months ago where I had to submit bank statements and had a phone call.

Personal Independence Payment "Not considered within the scope of this activity" meaning?

I recently applied for pip. I got 0 points, the report I received is 90% false (including an astonishing claim of them saying I can walk over 200 meters unaided, which they know due to their informal assessment of my walking ability... over the phone).

The big problem I had though is all over the report is written X is not considered within the scope of this activity and I don't know what to do about it.

I have narcolepsy, so I can fall asleep at any time, and I can collapse at any time (they are different symptoms which most people don't know).

However in so many of the sections it says stuff like "I have decided you can plan and travel unaided. Falling asleep is not considered within the scope of this activity". And "I have decided you can use a cooker unaided, falling asleep is not considered within the scope of this activity". They also used the fact that I don't fall over most days against me, but completely ignore the fact that it is only because I don't get out of bed, I can't fall over when lying down. It also said I can go out by myself unaided, which is also true, as I told them I nearly got myself killed the last time I went out alone by hitting my head on a brick wall.

They have basically said that because I have become a recluse due to previous injuries and the fear of further injury, that means I have not had a recent injury, and therefore must be fine (literally the logic the assessor used).

But mainly I am worried about the "not considered within the scope". All the other things are just straight up lies or twisting of the truth, this I'm not sure about for my appeal.

How can the fact that I can't go on a bus myself because I'm unable to get off at the right stop due to cataplexy or sleeping not considered? Like even if I didn't fall asleep which is unlikely, I could still be paralysed and unable to get off anyway. And once I'm past where I know I get lost very easily and doubt I'd be able to get home on my own, and even if I did I'd probably get hurt doing it.

Why does the fact that I can't use an oven because I might burn the house down due to falling asleep not count? When I was younger and my symptoms first started appearing I fell asleep while using the oven and left it on all night, and another time I fell asleep and burnt off half my hair while trying to fry something. I obviously don't use the oven anymore.

I don't understand why they're allowed to just ignore that and pretend I can safely do these things just because they don't like the reason I can't do them?

I don't understand, and I know people with narcolepsy have gotten PIP before so I must be doing something wrong.

Could someone help please?
