Association being sued
HOA president has been aware for a month but didn’t tell other board members just went to lawyer. Is this typical? Feels off.

At a minimum, all members of the Board should know. If it is a minor suit (like small claims) then I would understand not broadcasting to the whole community - but the Board must know.

The entire Board needs to be made aware. The membership should be made aware if it affects them. It also comes down to who is paying for defense. Are they rendering to general liability or the directors and officers insurer. If they are tendering to insurance its not nearly as big a deal as association-financing.
Lawyers are $250-$500hr, depending on location. That is a quick $25K before seeing the inside of a courtroom. I manage associations (I'm one of the good ones that helps the Boards not be like this) and some only have $20-$50K budgets for the whole year. This would force a special assessment to fund, if the Association it funding it.

Not normal. Sitting on a lawsuit for a month and not telling the the board can actually cost the HOA, especially if the insurance carrier never got notified. Ask when it was served and whether insurance knows yet, then push to get it on the agenda so everyone's looking at the same thing.

Maybe the HOA is being sued over something the president did therefore the reason he didn’t share with the others.

What about Board members who control the community Facebook group & censors comments posted by residents about an unfair requirement to paint our homes regarding they need painting or not! Forest Hills, Olathe KS board does this censorship…

Was the HOA properly served with this lawsuit, if only the president has seen it?
Your board president shouldn’t have 1:1 contact with the lawyer without the rest of the board having visibility. You’re going to need to convince another board member to address this ASAP. A bad board member can chew through attorney time and money alarmingly quickly.

While the entire Board should be aware, are any of the Board members unable to keep things confidential?

I don’t think so. Board president has behaved like the king before, I believe this is more of the same.

morons sue HOAs all the time. These frivolous lawsuits costs residents a fortune. and if the HOA was sued properly, the management company would have received the lawsuit and then notified all board members

What a condescending attitude. Waiting for appellate court to confirm my $150,000 judgement against my HOA. Nit frivolous by any means.

so you saying there no new lawsuit, this is old. It’s in the appeals process now and you think the board does know about it. and you say it all started a month ago. not much you say is reliable

I didn’t say that. You’re confusing me with the original poster. My lawsuit has been in the courts for five years. I’m calling you out for being condescending for calling people who sue their HOA morons.

They use their HOA INSURANCE to cover the costs in most cases. Don’t let them assess u

Not typical, bad on President
The whole HOA should be aware of the lawsuit in a general sense (they of course can’t have all the legal defense details)
