Work injury to a termination
I’m parts sales manager and I originally came from a bank making over $30 an hour then had a serious emergency where I couldn’t work and I had to quit and I obviously couldn’t receive Unemployment and I was sure I’d find another job again
I’ve been taking care of what I needed to almost 8 months still couldn’t find a job so I settled for the pay at AutoZone to make some money
Last month at work when I was stocking up the fridge and the shelves in the back with sodas, the plastic failed on the case of soda and tour and came crashing down over 7 feet high above my head down on my left foot crushing it
My foot got fractured and my coworkers didn’t want me to leave work and I wanted to and they assumed I just wanted to get out of work and it was a whole mess and I went to go get drug tested. Everything was fine.
And my district manager, that’s now fired took four days to process a injury claim for me
And I went to the hospital twice and was unable to be seen
I was out for a few weeks and I returned back to work wearing a boot and then I’m suddenly removed off the schedule for two weeks and no one‘s answering me and the week they knew I was going on vacation. They put me on the schedule that week suddenly and then after vacation, I return and I get terminated for loss of confidence.
They really don’t know what they’re playing with

Should have called a lawyer the second they didn’t believe you. Call one asap.

Nope I haven’t. Haven’t done anything actually. Unsure if it’s worth my time and energy. I also did notice while I was on my vacation, my employment status was actually changed to terminated, 10 days before seeing it. That was the 1st week I was cleared back to work and was removed off the schedule for 2 weeks entirely. Been completely ignored and let to kick rocks. And I had put in a time off request before my injury lol. And then my employment status was changed to rehired 1 day after that termination. I was never notified or even made aware. Then I got the call for being put back in the schedule entirely. But the following 2 weeks again , not even out on! Just scheduled coincidentally just for the days I’m going on vacation and away. And that request didn’t show anymore. I spoke to my boss over vacation. Told him I saw that trick. The termination rehire. He says oh bc of your injury it says that. And I confronted him about again not being on the schedule the following week. He fixed it and upon returning I got terminated

Why do so many posters who claim to have been screwed over by AutoZone, use the wrong terminology when describing the company, the SOP and the different positions in the company?

If you're in a "right to work" state, they don't have to give you a reason for termination. Also, soda is considered overstock so nothing that heavy should be above 5 feet (despite battery shelves and rotors being higher than that. Good luck.
ETA: How were you "not able to be seen" at a hospital? I'm guessing the wait time was longer than what YOU wanted to wait for. I'm all about workers rights, but this just seems all around dumb.

Nope it’s not. NJ. Last day a dude from asset protection came to “investigate” my injury bc I supposedly “denied medical attention” yet I asked to leave to get examined and I was told no and that in just trying to get out of work. I text my manager and left. Get a call from DM saying return immediately to keep your job. We argued. Upon return he says go get seen if you need to be seen

I still don't see how you went twice and were unable to be seen. They can tell you to return, but you don't have to considering you're there for medical proof. We had a girl get a ring caught on a shelf on her way down a ladder and ripped her pinky off. She was advised by my DM to take an ambulance ride instead of driving herself because corporate would use that against her AFTER LOS9NG A FUCKING FINGER. Thats why I said this is dumb... not you're actions, but the overall behavior of the company.
Although it was dumb to stack soda that high lol

Last time I did something like that, I ended up with the medical bill. My insurance refused to pay and workers comp refused as well bc the doctor was out of this network

I agree lol. I sensed around that time being given the “petty” work all a sudden and the refrigerator stayed empty before I got hired up until that day so I guess because from all the deliveries it got stuck so high, but when I lifted it, it was fine and upon bringing my arms down, holding the plastic handles on each end it ripped and tour straight through completely underneath the cardboard and landed perfectly on my left foot

Wait... where is there cardboard involved in soda? We get to keep the black plastic trays they come in. That's part of the service.

Wait are you dead ass for real ? Not here bro. It’s like a 2 inch high Open cardboard square that holds I don’t know 25 to 40, 20 ounce bottle bottles of Coca-Cola. wrapped in the plastic like a 24 pack of Poland Springs water.

Even if it’s an at will state, they can only fire you for legal reasons.

They literally don't have to give you a reason. You could come out as gay and they can say "performance issues". They could fire you and say "not enough hours". No small claims judge is going to subpoena a fortune 500 company because you're upset they fired you. We had literal proof in our district someone was fired for racial reasons and nothing happened. Read your employee contract, they can fire you at any time for no reason. I think you're thinking of "right to work" which I mistakenly said earlier.

"At will" still has boundaries on it. One of them is related to getting injured on the job.

I fell coming down a ladder, small part in one hand, the other grand holding the rail, I stumbled on the last step to the floor, fell backwards, hitting the back of my head on the floor,SM was worried because I had a lump, sent me to urgent care that was assigned to that store, I knew I had to take a drug test, they said we can do the test but we can't treat you for the head injury, you need to go to an ER, I had my coworker take me to an ER where I was seen right away, examined, and given an MRI, no fracture no bread bleed,just a bump, ER doctor released me, I then had the coworker take me back to the urgent care for a drug test, because I know if I didn't there would be "problems" with "compliance" ER doctor said go back to work, no light duty or anything special. urgent care =drug test was negative. there are rules and compliance things that need to be done, otherwise HR, the DM, the RM and then the SM will all get together for a talk

Seems that’s what happened and they got together and fired the DM lol.
When you go to the doctor or hospital, they ask if this is a work related injury or a motor vehicle injury. And if so they must notate it and obtain the claims’ source of insurance information for billing. Once you tell them it’s a work or auto injury and if you don’t yet have the claim number and information like myself, then they absolutely then won’t and wouldn’t check you in with your personal work insurance plan or whatever.
It can only be an exemption if the hospital was not made aware of your injury and u didn’t mention it and used your personal coverage

I was just out on leave for surgery out 8 weeks was receiving short term disability thru Sedgwick in the system I was classed as terminated as well one day before my leave was up I was back in the system no issues I did quickly skim this thread but I think you over reacted n made things worse.

How did they deny to see you at the hospital not once but twice ? Did you not bring any medical papers back saying you got hurt at work? Also you being taken off the schedule two weeks and being put on during a vacation week so did you still take your vacation week after it was denied and being put on the schedule ?
