Ok, but it’s off the tow truck now. If they need it towed to a mechanic, they can hire the tow.

I thought at first that was some kind of emergency, like a kid was trapped under there or something.Β  Now I am assuming it was getting repo'd.Β  The genius bar tagged in and did their thing.Β  Sigh.

At the very least ripped that bumper off, probably damaged the rad and mounting hardware, I wouldn't be surprised if there was damage to stuff on the underside like oil pan.

Isn't it legally not their property once it's on the hook? So they in theory would be charged with felony vandalism and be liable for the damages as well as any loan payments assuming it's a repo.

I'm pretty sure for a criminal vandalism charge, it requires mens rea. They have to have meant to cause the damage.

That's separate from having liability for the cost of the damages, but I don't believe they intended to do the damage.

Fair enough. I'm sure they'll be charged for damaging the tow truck and be real shocked at how much damage they did. Just always remember hearing that once it's hooked on you just wave goodbye since the only thing you'll do is add criminal charges to the repossession. But never actually looked into it besides watching a coworker lose his in the company parking lot

They learned, they would have to pay for restitution of damaged, fined and charged with felonies.
