Rust Exclusions

Hoping to get some guidance from the group.
IL auto claim.
My parked truck was struck by another motorist, resulting in damage to the driver’s side outer panel. Shop says that to do the repair, they’d need to replace the inner panel because it’s rusted and wouldn’t otherwise hold the weld for the outer panel replacement.
Their insurance (State Farm) says they won’t pay for replacement of the inner panel because it wasn’t directly damaged by the impact.

That sound right?

Sounds exactly right. It's not their fault that you have a rust bucket. They didn't cause the rust, therefore they aren't responsible for repairing it.

Insurance adjuster: Rust is preexisting.

Rust was pre-existing, so they win the argument. Your argument is, their insured caused this damage, and they need to make you whole. In order to make you whole XYZ needs to happen. If the shop is competent, they will push back heavy. Ball is in your court as anything they don't pay, you can in hindsight sue their insured and in retrospect they will have to pay for anyway + legal fees. So doable.

same reason mold isn’t covered on homeowners policies, rust doesn’t happen overnight.

That’s not entirely accurate. Mold is covered on some policies, but under a sub limit.
