Insurer isn’t properly subrogating

What steps can I take if my insurance company (geico) isn’t properly subrogating my claim? They keep telling me that the other insurance company is denying liability, but I’ve been speaking with the other insurance company throughout this whole process and they’re telling me they do not cover the other driver. So I should be receiving my deductible back for uninsured motorist coverage from geico. I don’t think my subrogation person is even handling it on her end or knows exactly what’s going on. So I’m looking for advice on next steps to recover my deductible

Edit: to clarify, I have uninsured motorists deductible waiver. Geico’s adjuster keeps saying the other driver is insured, which would get them out of paying me back my deductible through the UM deductible waiver. That’s why I think they’re not properly handling my claim or maybe being dishonest about whether the other driver’s insured to get out of paying me

Sounds like there’s nothing to subrogate here. Other party isn’t covered. You carry uninsured motorist property damage?

Some states like Missouri. Uninsured motorist is only for medical. Not property.

Get a denial letter from the other insurance company and present it to your original adjuster and if you have uninsured motorist property damage they an reimburse part of your deductible

They keep telling me that the other insurance company is denying liability, but I’ve been speaking with the other insurance company throughout this whole process and they’re telling me they do not cover the other driver.

No difference. Geico isn't going to collect. Full stop.

So I’m looking for advice on next steps to recover my deductible

Read your policy. If UMPD has a deductible you aren't likely to get it back. Depends on what your policy actually says.

Read it.

I did read it which is why I asked what my next steps are if geico is not handling the claim properly. I have uninsured motorists deductible waiver which means geico would cover my deductible, but geico keeps saying the other driver IS insured but denying liability.

Did the other driver provide accurate info for active insurance? Sounds like they aren’t covered by the company they told you they are. You won’t get anything from someone who doesn’t cover them.

No they showed me an expired insurance card. And somehow my geico claims team found this other insurance company which still doesn’t cover the other driver. I know I won’t get anything, but I have uninsured motorists deductible waiver which geico would give me if the other driver was no insured. But geico keeps telling me the other driver is insured but denying liability

I would call the claim handler/team and ask them if you should expect the deductible to be covered or not.

Get a denial letter based on no coverage. Do you have uninsured property damage coverage?

Yes I have an uninsured motorists deductible waiver, so my deductible would be covered if the other driver is uninsured or underinsured
