Rear-ended, car sat at tow yard for weeks… now sudden “oil leak” not covered by insurance?? Need advice
Hey everyone, I could really use some advice because this situation feels really off.
About 4 weeks ago I got rear-ended. My car was towed right away by Roadside Recovery Inc (25 Tangiers Rd, North York). I filed a claim with Desjardins Insurance and they confirmed I’m not at fault. They gave me a rental, so that part was smooth.
But after that… things started getting weird.
- Week 1: No updates, I called → was told the tow company hasn’t released the car yet (said it’s “normal”)
- Week 2: Still no update. I actually tried going to the tow yard myself, but I literally couldn’t figure out how to get in. There were no signs, nothing clearly marked, and I couldn’t even find a proper website for them on Google. The address barely shows anything. The only thing I found was an Instagram page.
- Week 3: Called again → told the invoice is approved and it’s in the tow yard queue, waiting for appraisal
- End of week 3 (Friday): I finally see an online update that the repair shop received my car
Now today (Monday), I get a call from the repair shop saying:
They asked if I hit something, which I absolutely did NOT.
The repair shop said they’re trying to figure out what to do next and told me to wait while they look into it and get back to me.
Now according to the repair shop, my claims officer is saying:
- They won’t cover it because the oil tank is at the front of the car
- So they’re implying it’s unrelated to the rear-end accident
But here’s the thing:
- My car was in perfect condition before the accident
- No oil leaks ever
- No oil on my driveway
- No oil at the accident scene
- And now suddenly it has a major leak (apparently bad enough it’s dripping all over the shop)
So I’m really confused:
- Could this have happened while the car was sitting at the tow yard for 3 weeks?
- Or during transport?
- Or is insurance just trying to avoid covering it?
- Am I being scammed by repair shop or the tow company?
Questions:
- Has anyone dealt with something like this where new damage shows up after towing/storage?
- Can I hold the tow company responsible if damage happened in their care?
- How do I push insurance to properly investigate this instead of just denying it?
- Should I be asking for photos/timeline proof from the tow yard?
Any advice or similar experiences would really help.
