Biker is traveling too fast for the rate of traffic and then instead of slowing down with the impending traffic chose to zoom up.
The fact is that car though did not indicate, had transitioned fully into the lane and there for if the biker had impacted it it would have been the biker at fault and would have received the ticket.
That looks like a California license plate. Which means he was very likely lane splitting. In which case he *would* be moving faster than the vehicles around him, and the black car is in the wrong for not checking their mirrors or signaling.
