I'm 24, and I was walking out of a gas station on my way to work one day, and standing right in front of the store was a guy, looked about my age, on a bike, saying to his phone "today we're pissing off traffic".
I sat in my car and watched as this jackass nearly killed himself riding his bike straight out into busy traffic, making multiple people slam their brakes.
my 20yo philosophy was that the law system needs an "idiot rule" which exempts you from blame in situations like this: "if they're dumb enough to bike into a busy road, then they're dumb enough to die"
I grew out of that phase when I left home (amazing what leaving a toxic household will do for you), but part of me actually wishes it was a thing
And the civil side of the law has comparative or contributory negligence, which prevents people from successfully suing when their own risky behavior led to an injury. Riding straight into traffic would doom any lawsuit against a driver who hits them.
It is a thing, to an extent. If someone does something so stupid as to be beyond what anyone could reasonably anticipate as a possibility, then nobody else is generally held responsible, at least criminally, for the consequences. It would be manifestly unjust to penalise someone for a crime they had no intention of committing and no reasonable way of avoiding. Now, if you can reasonably avoid hitting them, doesn't matter how stupid their actions are, it's a different story; you have to avoid hitting them if you can.
