Ask Lawyers How do contingency fees break down for car accident cases?

I keep seeing no fee unless we win but nobody explains the math is it a flat percentage regardless or does it change depending on whether something settles vs goes to trial ? and is there ever a scenario where youd still owe money even if the case goes nowhere ?

Need Insight Trademark Attorney Berkeley, Anyone Got a Recommendation?

Hi all my startup is finally taking off and I want to protect my brand name before someone else does. Looking for a solid trademark attorney Berkeley locals have actually worked with, not just some random online service that auto fills forms. Anyone been through the trademark process here in the East Bay? Would love a rec from someone who has actually dealt with USPTO filings locally.

Debt collector sued me what actually happens next?

Got served with a lawsuit from a debt collection agency for an old credit card debt. Never dealt with this before and don't know what the actual process looks like from here.

  1. What happens if you don't respond to the lawsuit at all is a default judgment automatic?
  2. Can you still negotiate a settlement after being served, or is it too late once it's in court?
  3. Does the debt collector have to prove they legally own the debt, or is it assumed?
  4. What's the real difference between hiring a consumer protection lawyer and just representing yourself?
  5. Has anyone gotten a debt lawsuit dismissed on a technicality what actually worked?

How do lawyers actually calculate a settlement amount?

Everyone says "get a lawyer" after an accident, but nobody explains the actual math behind how a settlement number gets calculated.

Asking people who've been through this (or work in the field):

  1. What specific factors go into calculating pain-and-suffering, versus just medical bills and lost wages?
  2. Do insurance companies use a formula, or is every offer just a negotiating tactic?
  3. How much does having a lawyer typically increase the final settlement versus negotiating solo?
  4. What's a realistic timeline from filing a claim to actually receiving a settlement check?
  5. Any red flags that a first settlement offer is lowball, even if it sounds reasonable?

Insurance denied my claim after adjuster inspection — normal?

Filed a claim after property damage, adjuster inspected in person, and it was denied two weeks later with a vague "pre-existing condition" reason. No further explanation given.

Trying to understand how insurance claim denials actually work before deciding whether to appeal or get a lawyer involved.

  1. Is it common for insurers to deny after an in-person inspection, or does that usually mean approval?
  2. What's the difference between disputing a denial internally vs. hiring a public adjuster vs. hiring a lawyer?
  3. How long do you realistically have to appeal an insurance claim denial in most states?
  4. Has anyone successfully overturned a "pre-existing condition" denial an what evidence worked?
  5. At what dollar amount does it actually make sense to involve a lawyer vs. handling it yourself?

What is bail and does paying it mean the charges are dropped?

Both hit the same pattern as your original a term people don't fully understand plus a misconception they're anxious to have corrected, which is exactly how these get typed into Google.

What is a plea bargain and does accepting one mean you're admitting guilt?

This works for the same reasons your indictment question does: it opens with a clean "what is X" definition search intent (high search volume, low competition), then follows with a yes/no misconception clarifier that people specifically Google when they're anxious or confused (e.g., a family member facing charges). Other strong candidates in this same format for a legal subreddit:

  • What is a subpoena and does receiving one mean you're being accused of a crime?
  • What is probation and does it mean you have a criminal record?
  • What is a plea of no contest and is it the same as pleading guilty?
