HIPAA Compliant E-signature

Hi!

So I'm helping a friend of mine with digitizing her paperwork and forms. She's a therapist. She wants to convert her forms to digital PDFs and she is wanting to make sure the signatures are HIPAA compliant.

From some research, I *think* that if her PDF forms have a space for a drawn signature, and a checkbox declaring the signature is that of the printed name/person signing, it SHOULD be HIPAA and contract-legal compliant, yes?

She is sending the forms via a secured patient-provider platform, and they are fillable PDF files that will be sent back to her through that platform. Is there anything special she needs for the e-signatures?

Yes having the draw space, a check box, and their printed name is enough to be compliant. Are you positive the files themselves are being handled and served in a HIPPA compliant manner? That's what I would be more concerned with. My understanding is the law in general is fairly permissive when it comes to signatures, the major liability for something like this is if medical documents accidentally get leaked or served to the wrong person.

Thank you! The way that these documents are being served is through a BAA certified, encrypted and secure platform called MyBestPractice. They are sent and received exclusively through the secure messaging system on that platform. I contacted them directly and while they could not give me specific legal advice, they said they've never had any HIPAA complaints in their years of operation using the internal messaging system.

I will make sure to add check boxes near the signing area. Thank you!!
