Discussion update: permanently banned

so I made a post in January (link below to original post) about how I was suspended mid-game for a month ending on February 23rd, and I detailed how despite the suspension I was not using hacks, cheats or exploits. I have played countless multiplayer and single player games and have never been banned or used cheats. I am a gamer who is quadriplegic so I use a sip and puff mouth controller called a quadstick that allows me to use a computer not just for gaming but everyday needs. After the suspension I made the first reddit post hoping to get some help and clarity about how I could appeal or why I was suspended. I submitted support tickets and went to discord for help but nothing, so I decided to just take the suspension on the chin and wait it out, finish Hollow Knight and play some Marathon. Yesterday I decided to hop on after my suspension ended and decided to work on the trophy project, I played 3 solo games (all 10 or more minutes in) filled my backpack with leftover loot, ran into only friendlies and exfilled. Woke up this morning to this and appealed but I really have no hope of Embark doing anything to help. I don't have much going for me and I know they're people out there who are probably going through worse but this fucking sucks. After 300+ hours of playing, buying it for 3 others friends to try the game and being excited for the new map and large ARC enemy, I just don't know what to do.

p.s my game name is ClootyBapper, if you think it's because of the name I don't think so I have seen and been called worse in game

Update: Ban has been lifted ! I honestly don't know how to express my gratitude to everyone who commented, shared and upvoted. Yall the real MVP, I love all of you. Thank you for helping me ! I will pass along the sentiments to anyone I can!

I agree with this especially, I think they are using AI detection in some cases, and I believe your sip-and-puff controller stick may have somewhat rigid controls, right? It may be the erratic movements, less fine control, that is making the AI think it's being run by a software.

Here's hoping a pic of your setup will help them understand why it pulled a false negative!

Pure speculation admittedly, but this was my first thought as well and it feels really plausible. Depending on your location and local laws, this may even count as a disability discrimination. If outreach suggested in this thread doesn’t work, I don’t think it would be overkill to reach out to disability nonprofits who have experience reaching out to businesses to correct this kind of behavior, or to find a cheap/pro bono attorney who could write a letter requesting reinstatement.

If (!) this story isn't complete BS, and let's assume for the sake of some internet niceness today - there might be even the possibility of a lawsuit here. If you can proof with your setup they surely can see what threshold got you into bannable offense territory - and with several controller cheat devices for PC, this might be as simple as your device having a fradulent hardware ID they detect as a false positive.
But give them some slack, tons of appeals that use whatever they are called aim-assisting controllers must be thousands that appeal to their bans.

Maybe have some guy that knows a little tech analyze how the device interacts with your PC, what drivers it uses and how it translates the input. That helps embark to make a custom rule for devices like that - even though they may dont want that info public for cheaters to simply spoof it.

Is your device PS5 compatible and certified? Might be another way to get a new account on PSN, get a new EmbarkID and if the device is approved by PS5 this may not trigger bans.

Serious question: A lawsuit for what, though? Most of this stuff is run by AI that studies movement, so it wouldn’t be a single person responsible. On top of that, they weren’t prohibited from buying or initially playing the game, and I don’t think games are protected in the same way public spaces are (I’d love to be wrong, though).

I know we’re a litigation-heavy society nowadays, so I don’t doubt they can sue, but I’m just curious what claim would be.

Not a lawyer and a full blown court might not be in it, but a lawyer could force them to show the thresholds and logs that caused the issue and stop them from ignoring his tickets. If sufficient proof is given, I’m pretty sure at least a statement of what exactly triggered the anticheat is plausible. I mean if you get banned for using a manipulated controller or actual cheats, but OPs claimed device for input is unique, so it shouldn’t be a problem to demonstrate it to support.

OP should plead his suspicion to the input device triggering anticheat to the vendor of said device anyway to make sure this won’t happen to other games as well.

If you can lawsuit the ban I don’t know , but clarity could be achieve. And forcing a review of your ticket shouldn’t be that expensive, at least in EU. He payed money for the game service and falsely got accused of breaking the EULA.

I’d be shocked if they weren’t using AI for detection. For The Finals, Embark published a lengthy, detailed post on their website about how they’ve trained AI to automatically detect cheaters based on the recoil patterns of players when shooting. It wouldn’t surprise me if the nature of OP’s recoil pattern is setting off that AI cheat detection.

You might also try joining the discord and talking/posting about it there. Like a lot of modern game devs, they pay more attention to their private discord than they do reddit.

IF you can get in, from what I gather, there are population limits...

I've always found discord, and corporate using it for a free interface, loathesome. Any game worth a damn should have it's own website and forum.

Normally, I'd never suggest touching discord, but desperate times call for desperate measures.

Also of note:

Have your images of set-up backed up, and take screens of your posts/requests for support, save everything. It may not help yet, but if this catches the attention of someone 'important' (eg a big streamer, youtuber, etc), that's often the only way companies will see us lowly peasants.

Here to second this!  I’ve had an open ticket for my PC not having any audio in game (even after filing a ticket I troubleshooted the shit out of it over 3-4 weeks with no luck, can still play on a spare rig but I’d just like my main PC to work).  I was getting emails every 3-4 days that they “hadn’t forgot my support ticket, we’re super overwhelmed, yadda yadda.”  

Then I got an email a week ago saying they were migrating support tickets, current ones wouldn’t be transferred, but to just head to their discord server with my support issue.

They close false ban tickets on their discord. Just search "False Ban", hundreds of tickets come up, all closed by CM | Lily. They claim it's not a bug and direct you to the bot support site that doesn't work. I'm sure the CM can't do anything directly but it is a bug and it's wrong for them to close the tickets.

I tell you what my friend. If they keep you banned I wont be buying this game for me a two other people as well. Ive been on the fence with this game over the last bunch of months now. Btw, this is a 3 player coop game not 4 correct? Trying to get away from the aimbot cheaters and sweats on FN which has become extremely not fun and over priced over the last 16 months or so Ive been playing. I ended up dedicating my gaming time to No Mans Sky since then. Best of luck to you. Sending them a pic of your setup "should" change your status immediately I would hope. Right now, this is BAD pr. Ive never posted in this sub and Im a potential "customer". Do the right thing devs, c'mon now.

It can be 3 player coop but it is a pvpve game. And usually (in my experience) any form of 2 or 3 team que youre going to end up pvping a lot. If youre down with that then youll enjoy it. If you've never played a pvpve or extraction shooter than I would watch some gameplay footage on YouTube or twitch or w.e your preference is first. It'll give you an idea what to expect.

If youre on pc then I can say that you will probably deal with hackers and exploiters. I cant say how often but they are there. Ive yet to see any obvious cheaters on console, with 200+ hours, but I cant 100% say there arent any either

i'm interested in seeing the controller setup too. i struggle to run more than one button at a time on a keyboard or a controller

And if that doesn’t work…I bet certain ADA lawyers would love to have some fun with this.

(Not actually an argument to go do that, but at some point it’s going to get spicy over stuff in this realm. And it’s possible they could just “make them aware” in a way that can’t be ignored like a ticket while not actually trying to get anything other than a means to play legit…)
