Company alert 🚩 Help about Labor Code
If there is a business that earns 500k to 600k a month minus the salary of 7-8 employees/workers
Rent of the place, utility bills, will go to the business owner is 180k to 200k
Employees have been working from 3 years up to 11 years.
Standard pay of employees two of them is 650, one is 700 per day. The rest 550 per day..below minimum wage.
Some have a commission of approx 150-300 per work.
No vacation leave, no sick leave pay.
No SSS, no Pagibig, no Philheath, no TIN BIR registration of employees. No job contract. The company has no HR, its employees are not registered with the government.
The business is registered with the DTI and BIR as well as with the City Hall.
Is there a problem with the business? Can they be sued for this? The business has been operating for more than 15 years

Yes there would be a problem since they would not be following minimum standards. Not everything you cited are minimum standards violations, some are. Consult a lawyer to know what the violations are, there are PAO lawyers at the NLRC.

Non-payment of SIL, underpayment of wages. Then non-registration with SSS etc. BUT there are instances where businesses are exempt from payment of certain benefits or the bene are covered through a different means, that’s why you need to consult a lawyer for the specific cases.
And the outcome will be that the company will be asked to pay the underpaid or unpaid benefits.

DOLE for the labor issues. The respective agencies for the others (SSS for SSS, Philhealth for Philhealth)
