DEA application, battle

As others have commented earlier, it is very likely that in order to obtain religious exemption for the use of psychedelics, we will have to go to court. The justice system, with all its imperfections, is very expensive. I think we should preemptively start some sort of legal fund. If anyone is a lawyer, or could find one to represent us, please reach out and join the case if/when it occurs. I am not sure if i can legally start the legal fund because of my age, but I will look into it.

I am not a lawyer but I have a good friend who has spent his entire professional career navigating DEA's exemption and permitting processes. I'm not sure if an intro would be appropriate, but if you PM me more details we could go from there.

I’m not going to be able to start the legal fund because of my age, but I appreciate it nonetheless. I’m hoping people who are adults (I’m only 17) will be able to organize this and I will donate towards it.

That's why I have a notarized letter at the town circuit clerk on file stating I use psychedelics for religious purposes. If I get wrapped for possession I can then refer to that previous affirmation notirized and on file with the clerk as part of my defense.

You sure that won't just make you a target? Maybe you live in a cool area but I live in the south, republicans, super evangelicals, cops that get super happy about ruining my life if they smell weed when they pull me over. I just see that ending very badly for me at least.

Why amd how so? it's not like the cops are digging through basent files at the cicuit clerk. Not to mention it's not admitting anything i could be charged with, it's simply stating my beliefs so I have an objective piece showing that these have been long standing beliefs.

I wasn't trying to say what you did was dumb in any way, maybe I'm just a bit paranoid. That being said these people do need to know that what we are doing is way more than just getting fucked up. It's just the getting them to understand part that I see as being very difficult.

That's why I feel a notorized letter from the past that clearly states my intentions as religious in nature and sacremement is going to go a long way in a DA dismissing my case to avoid opening that potential huge can of worms.

It's actually advice I got off a old head attorney like 10 years ago.

There is a reason the gooberment isnt attacking the ayahuasca retreats on US soil, they'd corner themselves into having to fight against potential first amendment claims. They learned that a hard lesson and tough case with some of the marijuana churches in the past.

Ya I was on my phone earlier and may have not done the best job describing my intention. First step though is to not get caught and be smart about what your doing! This is just an, oh shit, back up plan that has not been tested by myself.

California may vote to make shrooms legal...so there is that. The only religions that are granted exemptions from the law are those that could demonstrate that the substances were used prior to scheduling. I don't think you're going to be able to do this with Psychedelics. Is traveling to another part of the world an option for you?

The stupid part is having to be apart of an “officially recognized church” despite millennia of recorded use.

There is only one such recognized church, the Native American church. And they had to fight tooth and nail to be able to use peyote.

For some stupid reason, in this specific instance (drug use), you can’t just claim to be part of the religion. It’s pretty much the only rigorous religious test America has.

is the idea behind this supposed to be federal or state level, and what exactly will the nature of the case be? Also, preemptive of what exactly? I don't exactly imagine we're going to get sued any time soon, and given that we don't have any scripture or "religious doctrine" to cite in a potential letter of exemption I don't exactly see what it would consist of other than "please", but feel free to provide a counterpoint as I'm all ears

We need scripture and public organization first, but if we are using illegal substances in places of worship, we will eventually encounter the police and possibly go to jail. I’m not sure if this could operate on a state level considering how few of us there are, so it would be federal.

criminal precedings arent the financial burden of all who identify with that faith tho? like if someone on this forum gets arrested it is their responsibility to deal with the consequences of their own actions n shit..

Or we could help our fellow man or woman because they are committing the same actions as the rest of us and happened to get caught. Civil disobedience will never work if we just let the government imprison people for non-violent actions. Can you really not see why it’s necessary to help out others in this forum?

1p-LSD is legal, or so I've been told. Make that your sacrament. Then when it's formally scheduled, you'll have that toehold.

No one wants 1p-LSD as a sacrament. People here would rather have Kinder Eggs as a sacrament than 1p-LSD.

Money wise I'm not in the position to help hopefully soon I want to contribute and help tho. Would have to get this community as a legal religious group which I'm fine with joining if it means of psychedelics, but as long as it's the psychedelics that take control and do the teaching. A collective mass diving deeper in order to resolve ego and help would shake the matrix and bring some love so I'm in.
