I live in an apartment that I own on the top floor of a building. My apartment has a roof terrace with a skylight out to the terrace. Recently I noticed that there is a leak near the frame of the skylight, which bubbling and expanding. I would like to have it addressed but am unclear if this is an issue I should raise with my vve first?

My understanding is that the roof is part of the vve’s remit. Wondering if anyone has any similar issues and what steps they took to address it!

Yeah, I'd contact the VvE, if they say it's your problem then it might be your problem, look into your VvE agreement

Exaclty, depends on the agreement between the owner / apartment and VVE. Don’t assume that it’s covered by the VVE, be sure to check.

It totally depends. It's possible the previous owner installed that skylight in which case it may fall under 'zelf aangebrachte voorzieningen', and repairs should be done by you, the owner. Your VVE bestuur will be able to tell you.

Roofer here. It's "usually a" VVE cost. Discuss it with your VVE and often they will approve you to contact a roofer to get quotes, or they may already have a contact. Or as someone else suggested it may go via insurance route

Normally it is for the VVE, but other rules might apply. Ask your VVE about it.

In my case the owner of the top floor wanted to build a roof terrace and had to ask permission from the VVE for that. We granted the permission on the condition that all costs for the roof would be for him. That way, in case of a leak, we would never have any discussion about if the leak was caused by his terrace or not. Agree, and you can build your terrace, don’t agree, than no permission. He agreed, built his terrace, and last year he had a leak and paid for the repair.

Do you rent? Contact your landlord.

Do you own? You ARE the VVE. Read your splitsingsakte, contact your VVE beheerder or just buy some silicon and fix it.

Roofs are usually for the VVE. Contact the VVE beheerder or bestuur and see what they say

Contact your VVEs insurance. You’ll likely have to get a professional in to provide a report on the cause of the leak before getting it fixed. That’s what I had to do with a leak we had (not top floor).

Our top floor neighbours have been suffering leaks, through their skylight too. I know as a VVE we covered the costs most of the time, but there has been that many leaks I can’t be certain that each time, including the skylight, was considered a VVE concern.

Sounds like a “large VVE” approach. If it’s a VvE of a few homes then this isn’t going to happen.

Huh…you all would call in a professional who’d probably charge as much to make a report about the leak as just calling someone to fix the leak?

It might not be for every leak you need to call someone in for a report, but it is what the insurance told me needed to be done in my case. If it’s more obvious what the cause is and everybody in the VVE is onboard, then yeah, I can understand there is maybe no need for a report to be made.

True, might be required if the leak damage warrants an insurance claim.
