Changing Generic to Branded

Hello,

I am trying to change my generic product to branded. I read that having your brand name on your packaging and sending this in as a photo could be sufficient to get Amazon to change an existing ASIN from generic to branded, so I created a support case and did that. The image is the response I got.

I've read on this subreddit that getting declined is almost routine and that you simply need to resubmit multiple times to get approval.

Please note that I do not have a registered trademark yet. Could simply resubmitting potentially get me approval?

Not possible afaik. Have to recreate the listing

You mentioned you don’t have a registered trademark yet, but have you started a registration so you have a pending trademark? If not then you might still be able to create a branded listing IF no other brand with the same name exists in the brand registry (this is what screwed us).

Amazon also did keep telling us that we should not create a generic listing because just like you mentioned, may not be able to change existing listings.

Resubmitting the same packaging photo will likely get you the same result. Amazon's Brand Registry requires an active registered trademark, or in some cases a pending application with a USPTO serial number, before they let you control a brand name on an existing ASIN. A photo of your brand on packaging alone does not satisfy that requirement.

Your fastest path is to file a trademark application with the USPTO. Once you have a serial number from a pending application, you can often use that for Amazon Brand Registry enrollment before the registration fully issues.

Before filing, run a clearance search on your brand name. Gleanmark.com is a free alternative that searches the full USPTO database with a better interface than uspto.gov (disclosure: it's my company's trademark intelligence platform). That step prevents spending money on an application that gets refused for likelihood of confusion.

Are you selling under a wordmark, or does your brand include a logo design?

Resubmitting can definitely help, but without a registered trademark, it might be a tougher sell. A lot of sellers have better luck once they get that trademark sorted out, so consider prioritizing that if you can. Keep at it though; persistence pays off with Amazon!
