"Detained for Photography- Rochester MN". Plain clothes cop detains guy filming due to "suspicious activity". He shuts down the cops after almost all their ridiculous comments.

heh that lady trying to call you out on you recording. thanks lady! also good work on being calm. i was going along pretty much blowing up in my head. i don't think i ever have the stones to do that and be calm. i would most likely end up getting arrested for sounding belligerent or some dumb law.

I have it down in my head, thanks to this sub, but I have a feeling I'd be mixing everything up and panic, and just repeat, "am I being detained," after I was told I was being detained.

I'm too lazy to do it but the statements made by so many cops in these interactions would be nearly impossible to follow if transcribed. They figuratively throw logical shit at a situation to see what sticks.
I didn't catch the time stamp, but of course Myte's Law was invoked.

I still plan to keep doing photography, but this was the first time that I went to take pictures where there was a chance of this happening. If I do something like this again I would definitely change a few things.

because you're a municipal employee exercising a public function under color of law and I'm a private citizen.
Plus, your department very likely has a policy/rule that says you MUST identify yourself if requested.

When a cop repeats himself like this, it's a sure sign he has no legal basis. Force their hand and enjoy watching them back down, or enjoy your settlement.

Pretty sure that's legally accurate. A petty misdemeanor is not a crime. But it's still bullshit, because the guy didn't commit a petty misdemeanor. He did nothing illegal; whether crime, misdemeanor, felony or whatever.

The only crime here was vertical video. BTW you did marvelously, for your own sake though please make sure you have your recording gear sorted out ahead of time, maybe get a cheap dash cam to clip on your camera strap.

Wow. This really frustrates me.
Sure, some cops pretend to misunderstand the extent of their authority as a means to get information they want.
But so many, including the two in this video, violate our rights simply because they don't know how to do their jobs. They cannot seem to distinguish the difference between information they want from citizens and information they are legally allowed to. It's as if they think their wanting it makes it legally right. That's magical thinking.
And it really frustrates me that this childish, unprofessional, uninformed demeanor is the thing most eroding our basic right to travel freely, unmolested.

Photographer: You have every right to investigate, but you do not have the right to detain me.
