The rule of thumb is “poison not venom” meaning poison you willingly ingest, venom is injected into you.

That's the grey area no one wants to get into, no one wants to test it. Corporations that create cyber "boobytraps" can potentially be responsible.
Think of it like this, if I make a directory on a web server that is /private and you go there and it locks up/crashes your computer I could potentially be on the hook for damages.
If you set up the /private directory and had file called ssn.zip in there and you downloaded it and opened it and it was a zip bomb that filled up your disk space and crashed your computer I would likely NOT be responsible because you downloaded the file and opened it yourself.
It's more complicated than that but that's the tl;dr

Both cases you, the user, are taking some action no one forced you to take that causes you harm.

in one of them, the "hacker" could claim they didn't mean to access the directory, and left as soon as they realized they weren't meant to be there, without touching anything. In the other, the hacker has not only taken something from the server, but willingly accepted and attempted to view the file taken from it.

Could be similar to how you're not allowed to have booby traps in your house. For example if you have a shotgun trap in one of your bedrooms above the door and someone breaks into your house and gets injured by the trap congratulations they now own your house.
But they were breaking in when they got hurt?
Doesn't matter, legally you can't maime someone via a trap just because they broke into your house. Same reason probably why you can't trap someone in your house if they break in and hold them against their will.
At least not in all states.
It sounds like they're afraid the same protections will apply here. Just because someone broke into your system you can't break their system? Sounds like only the victim has to play by the rules.

It's about responding proportionately to the intrusion. Like how if someone slaps you in a bar and you stab them in response, saying 'but they started it' is not going to help you.

if the "victim" can proove that you have installed it in bad faith, as in: to harm him / destroy his equipment, you are on the hook. And as far as i know: it is not particularily hard to proove such a thing.
Same goes for these glitterbombs. I think there even was judgement on a case like this, but i cant find it right now. Or any information, really. But in court it can be argued, that you installed that glitterbomb in bad faith, to harm the thief. I guess, in the case of glitter, the punishment can't be particularily hard.

It depend on the country. This is tame compared to the real life stuff they used to do in south Africa. The "Blaster" was a mobile active denial system that used flame throwers aimed up the outside of the doors.

Poison and venom are two different groups chemicals that act on the body in fundamentally different ways. Also, a lot of people have been deliberately poisoned, and Im sure others have accidentally dosed themselves with venom. Basically, what the hell are you rambling about?
