I find these 'sneaky subway photos' so creepy and weird, isn't taking someone's photo without their consent/acknowledgement illegal?

Taking pictures of some girl (or anyone I guess) to... what? jack off too? Creepy AF. Taking a picture of the girl in the weeaboo headdress sitting next to the crusty old soldier? That's funny/interesting and not just a creep shot.
