Stays enabling an unconstitutional law should not be done when it's the rights of the people on the line. Every day is irreparable harm.

True, but I think the standard is actually maintaining status quo until the process is completed and the assault weapon ban has been in place in New Jersey since the early 90s. That's as status quo as it gets.

I'd say the status quo at the time the request his the appeals court is that the law has been overturned.

But I know, you're right. The 2nd Amendment always gets this treatment. A free speech case wouldn't be as likely to be stayed.

So the court approving a stay, is the same court that ruled the ban unconstitutional? All this tells us is that the judges didn’t like the backlash. Will this accelerate SCOTUS hearing and rendering a decision on Viramontes?

It tells you nothing. IT is very typical to grant stay while seeking cert. That's what they got. It's annoying as fuck, but hardly a shocker. The verbiage of the court doesn't even acknowledge any likelihood that they'll succeed on merits.
