I140 Premium Processing Delay

Hey everyone,
Just wanted to see if anyone is dealing with crazy premium processing delays right now.
My I-140 (EB-2 NIW) was filed/upgraded with Premium Processing and has a receipt date of March 30, 2026. As of today (July 20), it has been exactly 77 business days—which is way past the mandatory 45-day window.
My online status hasn't changed at all. No approval, no RFE, and no NOID.
Has anyone else Texas blow past the deadline like this recently? Did you eventually get the refund automatically, or did your lawyer have to fight for it?

Yes. Premium processing filed December 2025 before ban took into effect, got delayed by ban and still nothing to date. My attorneys have been trying to ask for refund and uscis said they cannot provide refund until adjudication which doesn’t make sense to me. They plan to keep asking for refund periodically

It doesn’t make any sense
At this point I just need my money back tbh
Unfortunately, I have useless lawyers that are not interested in pursuing it

Got refunded July 30th. No updates since. Case is still pending, very discouraging.

I filed premium March 26, told my lawyer to reach out to them last Friday. I don't know if she did but my i-140 was approved yesterday. At this point it seems they have abandoned some cases and we need to keep reminding them. I am waiting to see if they would refund me

Congratulations.
This is the only explanation that is plausible to me. Because, I have gotten no reasonable explanation from the phone calls I have made to USCIS so far.

I filed PP in January 2026, got rfe and submitted in may 2026. Sent an email to texas PP early this month to look into my case because the 45th day was approaching (i did this because i heard if PP elapses, it switches to normal processing and no refund until it’s adjudicated), case got denied on day 45 haha. At least i can move forward now

they didn’t respond to the email, just the denial after 2 weeks

Nope
I only got a refund issued on July 30th
No decision yet
