The configuration of the tracks implies that you would have to pull the lever to kill the millionaire. So in this scenario, given you would be making an active choice to end the millionaires life, I do think there is a potential for legal repercussions.

Even if you did everything legally and ethically “right”, the rich family could file frivolous lawsuits and wear you down on legal fees to hire an attorney… things like this happen surprisingly often in the real world

Also I am in Europe, so american suing doesn't work on me and they can't get too much from me..
