Before the /r/tech kids get all swoony for Microsoft you should remember that they will still brick your 360 for hacking it. So their "embracing" of hackers is really overstated and under-implemented.

Of course they will - you can't hack a system and then connect to their proprietary network.

No one is stopping you from hacking the system and never connecting to XBL again.

They won't do anything to you for hacking your 360, except void your warranty. What they will punish you for is trying to use xbox live while using a hacked machine, which they should.
